Requires the Judiciary to conduct a study to determine the ability, best approaches, various issues, and potential impacts of requiring courts to disassociate a residential tenant from an eviction proceeding brought by a landlord in certain circumstances. RELATING TO WORKERS' COMPENSATION. Repeals the authorization of a physician to transmit a treatment plan by mail or facsimile to an address or facsimile number provided by the employer. Requires employers denying a treatment plan to file a written denial with the Director of Labor and Industrial Relations within seven days of receipt. Places the burden of proof on the employer to establish by a preponderance of medical evidence that the denial of the treatment plan is justified. Establishes a presumption that a denial of a treatment plan not supported by a medical opinion or relevant medical records existing at the time of denial shall be without reasonable grounds. Clarifies that a treatment plan is deemed accepted if an employer fails to file a written denial within the seven-day period. Requires employers to pay the appropriate health care provider for any medical care set forth in a treatment plan that is accepted or deemed accepted. Establishes penalties for employers whom the Director found to have denied a treatment plan without reasonable grounds, frivolously, or primarily for purposes of delay, or to have failed to pay for an injured employee's medical care under an accepted treatment plan. RELATING TO WORKERS' COMPENSATION. Authorizes an attending physician to request a functional capacity examination and refer an injured employee for the examination without first obtaining permission from the employee's employer in order to assess the employee's ability to return to work. Allows licensed occupational and physical therapists to be deemed qualified to perform functional capacity examinations. Effective 1/1/2077. (SD1)

RELATING TO CONSUMER PROTECTION. Establishes limits on transactions through digital financial asset transaction kiosks. Requires operators of digital financial asset transaction kiosks to use blockchain analytics and tracing software to prevent fraud; make certain disclosures; provide receipts to customers; provide full refunds under certain circumstances; hold new customer transactions for a period of at least forty-eight hours; and provide live customer service and a dedicated communications line for the Attorney General, Office of Consumer Protection, Department of Law Enforcement, and county police departments. RELATING TO HOUSING. Deems a county inclusionary mandate as a form of development exaction and treats the mandate as a housing affordability impact fee, with certain exemptions. Prohibits a county from adopting, amending, or enforcing an inclusionary mandate or inclusionary mandates for residential or mixed-use development, under certain circumstances. Establishes additional requirements for a needs assessment study for a county-imposed inclusionary mandate. Effective 7/1/2050. (SD1)

RELATING TO IMMIGRATION. Requires state and county law enforcement agencies to notify an individual in the custody of a state or county law enforcement agency of their rights before any interview with federal immigration authorities pertaining to certain matters regarding civil immigration violations can commence. Designates all records relating to federal immigration authorities access to detained individuals provided by a state or local law enforcement agency as government records. Requires state and county law enforcement agencies that have provided federal immigration authorities access to a detained individual within the previous year to hold two public forums per year. RELATING TO THE SAFETY OF EDUCATIONAL WORKERS. Part I: Requires the Department of Education and state public charter schools to take certain steps to better address the harassment of educational workers, including sports officials. Authorizes the Attorney General to assist educational workers, including sports officials at department of education or public charter school sporting events, who have been subject to harassment or intentional bodily injury in obtaining a temporary restraining order. Part II: Clarifies that a sports official's duties cover sports events at public schools and private schools. Makes intentional or knowing bodily injury of an educational worker or a sports official engaged in the lawful discharge of their duties a class C felony for the first offense and a class B felony for a second or subsequent offense within ten years. RELATING TO HEALTH. Specifies that no person is subject to liability for providing clinical preventive services in accordance with Department of Health recommendations. Requires health insurers, mutual benefit societies, health maintenance organizations, and plans established by the Hawaii Employer-Union Health Benefits Trust to provide coverage for clinical preventive services. Authorizes the Department of Health to make recommendations relating to clinical preventive services and issue standing orders for medications and immunizations. Clarifies that, for coverage for child health supervision services, the prevailing medical standards include recommendations by the Department of Health. Specifies that coverage for clinical preventive services shall not be denied on the basis of medical necessity or subject to prior authorization. Specifies that a registered pharmacist may order a vaccine in accordance with the recommendations from the Department of Health. Exempts this measure from an Auditor impact assessment report. RELATING TO HUMAN TRAFFICKING. Requires the Department of the Attorney General to develop a Human Trafficking Awareness Training Program to educate and train workers in the transient accommodations sector. Requires transient accommodations employers or transient accommodations third-party contractors to periodically provide the human trafficking awareness training to certain employees and contract workers, keep records of the training, post signage, and develop and implement a human trafficking prevention policy that includes procedures for the reporting of suspected human trafficking. Establishes penalties. Requires the Department of Law Enforcement to adopt rules. Effective 3/22/2075. (SD1)

RELATING TO THE STATE HEALTH PLANNING AND DEVELOPMENT AGENCY. Amends the functions and responsibilities of the State Health Planning and Development Agency. Adds a new definition of "health care" for chapter 323D, HRS. Amends the exemption threshold for bed changes to up to thirty per cent of existing licensed bed types. Exempts the Department of Health from certificate of need requirements. Effective 1/30/2050. (SD1)

RELATING TO THE TAKING OF MARINE DEPOSITS. Authorizes the Department of Land and Natural Resources to approve permits for research, education, management, or propagation purposes that include the taking of marine deposits seaward of the shoreline, as long as the resources will be returned to the beach if possible and that the taking poses no more than a minimal or negligible risk to the environment. RELATING TO BIODIESEL. Requires the Director of Business, Economic Development, and Tourism to implement a requirement that, no later than January 1, 2028, diesel fuel sold in certain counties for use in on-highway diesel-powered motor vehicles contains no less than five per cent biodiesel by volume, except in circumstances where the supply of biodiesel is insufficient. Requires the Department of Business, Economic Development, and Tourism to submit a report to the Legislature, including a comprehensive rollout plan. Requires the Director of Business, Economic Development, and Tourism to consult with the Department of Transportation during the development and implementation of the biodiesel requirements and present DBEDT's comprehensive rollout plan to the public. RELATING TO THE MAUNA KEA STEWARDSHIP AND OVERSIGHT AUTHORITY. Part I: Clarifies the powers of the Mauna Kea Stewardship and Oversight Authority so that it may carry out its intended duties regarding land use on Mauna Kea. Part II: Adds reversion dates of 6/30/2028 and 12/31/2029 if timelines requiring the adoption of a management plan or sending of proposed administrative rules to the Governor are not met; extends the transition period to 12/1/2029; requires the University of Hawaii to transfer the various Mauna Kea astronomical observatory conservation district use permits to the astronomical observatories; clarifies that the oversight and interest of MKSOA in the Mauna Kea lands shall be no more than the University of Hawaii's leasehold interest in the Mauna Kea lands unless otherwise agreed to by the Board of Land and Natural Resources. Part III: Provides that the existing plans and administrative rules adopted or developed by UH under which Mauna Kea is currently governed remain in effect until plans and administrative rules adopted by MKSOA take effect. Part IV: Clarifies that MKSOA has state sovereign immunity. Part V: Authorizes MKSOA to extend leases and subleases before the expiration of the transition for up to an additional ten-year term. RELATING TO MENTAL HEALTH. Expands the services eligible for Medicaid Prospective Payment System reimbursement to include certain services furnished by a federally qualified health center or rural health clinic and provided by mental health professionals under the clinical supervision of a licensed mental health professional. Requires the Department of Human Services to adopt rules for this purpose and seek federal approvals as necessary. Specifies that implementation is contingent upon and only to the extent approved by the Centers for Medicare and Medicaid Services. Effective 7/1/3000. (HD2)

RELATING TO POLITICAL FUNDRAISING BY EXECUTIVE BRANCH EMPLOYEES. Prohibits any Executive Branch employee who is nominated or appointed by the Governor to a compensated position subject to confirmation by the Senate and who exercises authority or significant influence over the solicitation, award, or administration of state contracts, from engaging in certain campaign fundraising activities. Permits hospitals to demonstrate compliance with all licensing inspections required by the State through accreditation or certification by any accreditation or certification organization approved by the Centers for Medicare and Medicaid Services. RELATING TO HOME HEALTH LICENSING. Authorizes the Department of Health to accept accreditation from an accreditation organization or a certification organization approved by the Centers for Medicare and Medicaid Services as demonstration that a licensed home health agency is in compliance with all licensing inspections required by the State. Specifies conditions under which a home health agency may be exempt from a licensing inspection on a continuing basis. Requires information obtained in reports of survey and accreditation or certification letters to be public information. Effective 7/1/2050. (HD2)

RELATING TO DIGITAL FINANCIAL ASSET TRANSACTION KIOSKS. Establishes limits on transactions through digital financial asset transaction kiosks. Prohibits (1) the exchanging of United States currency, in an amount greater than $100, from new customers for digital financial assets; (2) any two customers from transacting to the same digital financial asset wallet address; and (3) beginning 1/1/2030, the exchange of United States currency from customers for digital financial assets. Requires operators of digital financial asset transaction kiosks to use blockchain analytics and tracing software to prevent fraud; make certain disclosures; provide receipts to customers; provide full refunds under certain circumstances; and provide live customer service and a dedicated communications line for the Attorney General, Office of Consumer Protection, Department of Law Enforcement, and county police departments. RELATING TO THE PUBLIC UTILITIES COMMISSION. Requires the Public Utilities Commission to establish performance-based incentives, including revenue adjustment mechanisms, cost control mechanisms, and reward and penalty mechanisms on or before 1/1/2027. Clarifies that the Public Utilities Commission is authorized to adopt alternative ratemaking procedures to establish electric utility rates and performance-based incentives. Requires the Public Utilities Commission to apply a presumption in favor of considering historical cost trends and external indices that reflect incentives to control costs if the Commission resets an electric utility's allowed revenues based on consideration of the utility's costs. RELATING TO WATER CARRIERS. Requires the Public Utilities Commission to establish automatic adjustment mechanisms to address economic factors sua sponte or on application by a water carrier. Requires the Public Utilities Commission to establish a water carrier inflationary cost index automatic adjustment mechanism. Authorizes the Public Utilities Commission to waive or exempt any water carrier from any requirement under the Hawaii Water Carrier Act. Sunsets 7/1/2029. Effective 7/1/2050. (HD2)

RELATING TO THE DEPARTMENT OF HEALTH'S AUTHORITY TO REGULATE FOOD, DRUGS, AND COSMETICS. Removes duplicative food-related statutory material and aligns all food-related provisions under chapter 328, HRS. Ensures adequate statutory authority for permits, fees, inspections, and enforcement. On 6/30/2027, repeals the Sanitation and Environmental Health Special Fund and transfers any unexpended or unencumbered balance to the newly established Food Safety and Environmental Health Special Fund. Makes conforming amendments. Effective 7/1/3000. (HD2)
