Requires the Department of Health to respond to reports of persons with severe mental illness who need assistance, assess whether they meet criteria for assisted community treatment, and coordinate the assisted community treatment order process when appropriate.  Provides that denial of a petition for involuntary commitment serves as notice to DOH to evaluate the individual for assisted community treatment.  Requires the Director of Law Enforcement to adopt rules establishing training and certification standards and procedures for crisis intervention officers.  Clarifies the scope of treatment permitted under assisted community treatment orders.  Requires the Department of the Attorney General to assist with the preparation, filing, and presentation of requests for court or administrative authorization to provide treatment over a patient's objection.  Effective 12/31/2050.  (SD2)

RELATING TO PSYCHOLOGISTS.

Establishes a pilot program in the County of Kauai to allow qualified psychologists limited authority to prescribe psychotropic medications to patients under the care of the psychologist in certain circumstances.  Requires the Board of Psychology to adopt rules.  Requires the State Health Planning and Development Agency to report to the Legislature.  (SD2)

RELATING TO VETERINARY MEDICINE.

Requires veterinarians to provide a written prescription, upon the request of a client, for any animal patient of a client with whom the veterinarian has established an existing veterinarian-client-patient relationship, to be filled at the pharmacy of the client's choosing.  Allows pharmacies licensed in the State to dispense medications prescribed by veterinarians.  Authorizes the Hawaii Board of Veterinary Medicine to establish penalties, which may include fines or suspension or revocation of a license.  Effective 7/1/2050.  (SD2)

RELATING TO CONSUMER PROTECTION.

Prohibits operators of smart household security devices from sharing user data with law enforcement agencies unless the user consents or the law enforcement agency obtains a judicial warrant.  Prohibits operators from requiring users to consent to share data with law enforcement agencies to use a smart household security device.  Allows the Department of the Attorney General or the Office of Consumer Protection to bring a civil action against operators who violate certain requirements and establishes statutory penalties.  Effective 7/1/2050.  (SD2)

RELATING TO NATURAL RESOURCE MANAGEMENT.

Provides for the repeal of the Mauna Kea Stewardship and Oversight Authority and reversion of management authority over Mauna Kea lands to the University of Hawaii if the timelines specified in Act 255, SLH 2022, are not met.  Establishes a deadline of 7/1/2030 for the transfer of appropriations, records, equipment, and other property to the Mauna Kea Stewardship and Oversight Authority.  Authorizes the Authority to extend existing leases and subleases for up to an additional 10-year term.  Effective 7/1/2050.  (SD2)

RELATING TO FARM EMPLOYEE HOUSING.

RELATING TO MOTOR VEHICLES.

Requires new number plates and tags or emblems for used motor vehicles transferred between private individuals.  Requires each county Director of Finance to notify all applicable state and local agencies upon receipt of official notification of a vehicle transfer from a transferor.  Requires each county Director of Finance to establish a centralized notification system for applicable agencies for every vehicle transfer by 7/1/2028.  (SD2)

RELATING TO MOTOR VEHICLES.

Authorizes the impoundment of motor vehicles when certain traffic violations have been alleged or committed.  Provides that if a law enforcement officer lawfully stops a motor vehicle and the operator is cited for driving without a valid license, the officer shall not permit the operator to resume the use of the motor vehicle.  Requires the motor vehicle to be moved by a licensed driver or towed at the owner's expense.  Provides that the cited operator is responsible for arranging the operator's transportation from the scene of the stop.  Effective 3/22/2075.  (SD2)

RELATING TO STATE WATER CODE PENALTIES.

Adds a minimum penalty and maximum penalty per violation of the State Water Code.  Authorizes the Commission on Water Resource Management to consider each day that a violation exists or continues to exist a separate offense.  Establishes factors the CWRM must consider when determining the amount of the penalty.  Increases maximum fines every 5 years from 2031 to 2046.  Effective 7/1/2050.  (SD1)

RELATING TO CHARTER SCHOOL FACILITIES.

Authorizes the School Facilities Authority to use public-private partnerships for the development of public school facilities, including facilities at public charter schools.  Requires the School Facilities Authority to establish a pilot program to develop three new public schools in areas based on demonstrated need through public-private partnerships.  Requires reports to the Legislature.  Appropriates funds.  Effective 7/1/2050.  (SD2)

Makes it an unfair or deceptive act or practice for businesses to:  offer, display, or advertise the price of live-ticket events or short-term lodging without clearly and conspicuously disclosing the total price; and misrepresent any fees or charges in any offer, display, or advertisement for the sale of live-event tickets or short-term lodging.  Effective 7/1/2050.  (SD2)

RELATING TO CONSUMER PROTECTION.

Requires any person or entity selling a residential solar energy device to comply with consumer protection laws.  Prohibits the sale of a residential solar energy device without a contractor's license or contractual affiliation with a licensed contractor.  Requires a standardized disclosure form to be developed by the Department of Commerce and Consumer Affairs for use in all residential solar proposals and contracts.  (SD2)

RELATING TO UNDERGROUND STORAGE TANKS.

Requires an owner or operator of an underground storage tank or tank system with a confirmed release to meet certain standards for the restoration of the environment.  Effective 3/22/2075.  (SD2)

RELATING TO PHARMACY BENEFIT MANAGERS.

Establishes requirements for pharmacy benefit managers that reimburse contracting pharmacies for drugs on a maximum allowable cost basis, including maximum allowable cost lists, maximum allowable cost reports, and a complaint process.  Requires pharmacy benefit managers to disclose lower-priced equivalent drugs when a maximum allowable cost is upheld on appeal.  Allows contracting pharmacies to reverse and rebill claims if a maximum allowable cost is denied on appeal.  Authorizes the Insurance Commissioner to adopt rules and assess fines for violations.  Appropriates funds.  Effective 1/30/2050.  (SD2)

RELATING TO TRANSPORTATION.

Authorizes supporting documents used to transfer ownership of a motor vehicle to an insurer after payment of damages from the result of a total loss insurance settlement to be signed electronically.  Requires insurance companies to indemnify and hold harmless the Director of Finance for any claims resulting from the issuance of motor vehicle titles utilizing documents signed electronically without a notary.  Effective 7/1/2050.  (SD2)

RELATING TO PUBLIC SAFETY.

Prohibits the Hawaii National Guard from deploying to assist federal troops, federal law enforcement, or the national guard of any other state operating in Hawaii when the Governor has objected to the deployments.  Effective 7/1/2050.  (SD2)

RELATING TO LAW ENFORCEMENT.

Prohibits law enforcement officers from using any personnel or funds originating in the State to assist or facilitate conduct by federal immigration agents that is for the purposes of civil immigration enforcement or exceeds their law enforcement duty or authority.  Prohibits law enforcement officers from assisting or cooperating with or allowing resources to be used to facilitate federal immigration agents engaged in operations with the purpose of civil immigration enforcement or that target individuals or entities for activities protected by the First Amendment of the United States Constitution or immigration enforcement operations.  Effective 7/1/2050.  (SD2)

RELATING TO RESIDENTIAL CONDOMINIUMS.

Clarifies the Ninety-Nine Year Leasehold Program to:  (1) Require at least sixty per cent of the residential condominium units within urban redevelopment sites to be set aside for owner-occupied residential use for not less than ten years from the date of initial purchase of the unit;  (2) Amend eligibility requirements to buy or own a residential condominium unit within an urban redevelopment site to allow an individual to own other real property;  (3) Amend the term "owner-occupied residential use" to include the renting or subleasing by the owner of a residential condominium unit to any tenant or sublessee of any kind; and  (4) Allow the sale of up to forty per cent of residential condominium units to qualified residents if there are units available after being advertised for sale for more than sixty days.  Effective 7/1/2050.  (SD2)

RELATING TO THE DEPARTMENT OF LAND AND NATURAL RESOURCES.

Clarifies that rules adopted by the Department of Land and Natural Resources pursuant to section 190-3, HRS, may regulate aquarium fish permits.   Establishes a criminal penalty and monetary fines for aquarium fishing violations.  Clarifies that each fish or aquatic life specimen taken in violation of certain fishing laws regarding aquarium fish and the possession and use of prohibited explosives, electrofishing devices, and poisonous substances constitutes a separate offense.  (SD1)

RELATING TO THE PSYCHOLOGY INTERJURISDICTIONAL COMPACT.

Adopts the Psychology Interjurisdictional Compact to regulate the practice of telepsychology and temporary in-person, face-to-face practice of psychology by psychologists across state boundaries in the performance of their psychological practice.  Requires the Department of Commerce and Consumer Affairs to adopt rules to implement and administer the Compact.  Implementation effective January 1, 2028.  Effective 1/30/2050.  (SD1)

RELATING TO HEALTH INSURANCE.

Establishes a three-year Health Coverage Continuity Pilot Program to be administered by the Department of Human Services, in consultation with the Department of Commerce and Consumer Affairs, to subsidize the cost of certain health insurance deductibles for eligible individuals.  Authorizes the Department to contract with a nonprofit health insurer or community-based organization to operate the Pilot Program; provided that the Department shall allow the operator to access state-backed reinsurance or risk stabilization support for the operation of the Pilot Program.  Requires reports to the Legislature.  Appropriates funds.  Repeals 6/30/2029.  Effective 7/1/2050.  (SD2)

RELATING TO HEALTH CARE PLANS FOR WORKERS.

Requires the Department of Labor and Industrial Relations, in consultation with the Insurance Commissioner, to establish and implement a five-year voluntary Nontraditional Workforce Portable Health Care Benefit Plan Pilot Program that offers high deductible health plans or catastrophic health plans to nontraditional workers who are ineligible for health benefits provided by the Hawaii Employer-Union Health Benefits Trust Fund or prepaid health care plans under the Prepaid Health Care Act.  Requires reports to the Legislature.  Appropriates funds. Effective 1/1/2077.  (SD1)

RELATING TO MENTAL HEALTH.

Expands the services eligible for Medicaid Prospective Payment System reimbursement to include certain services furnished by a federally qualified health center or rural health clinic and provided by mental health professionals under the clinical supervision of a licensed mental health professional.  Requires the Department of Human Services to adopt rules to allow medical assistance reimbursement payments for services provided to recipients eligible for Medicaid benefits under any plan under Medicaid managed care programs in the State by unlicensed mental health professionals under the clinical supervision of a licensed mental health professional.  Requires the Department of Human Services to seek necessary waivers and any additional approvals from the Centers for Medicare and Medicaid Services.  Effective 1/30/2050.  Implementation begins 7/1/2028 after approval by the Centers for Medicare and Medicaid Services.  (SD1)

RELATING TO WASTEWATER MANAGEMENT.

Requires certain wastewater treatment works to test sewage sludge and any other residual material for the presence of PFAS.  Requires the Department of Health to adopt administrative rules for the monitoring, sampling, testing, and data collection of sewage sludge and other residual material that contain specific amounts of PFAS.  Prohibits the issuance or renewal of permits if testing yields PFAS in sewage sludge or other residual material on land used for agronomic purposes, on land where drainage tiles have been installed, on land that drains into waters of the State, or land in a 500-year floodplain.  Effective 7/1/2050.  (SD2)

RELATING TO PESTICIDES.

Requires quarterly rather than annual reporting of certain uses of restricted use pesticides.  Amends the contents of reports to include specific geospatial data and information and increased detail on the amount of restricted use pesticides used.  Exempts wood preservative pesticides from reporting requirements.  Requires the Department of Agriculture and Biosecurity to develop an online reporting tool for restricted use pesticides.  Appropriates funds.  Effective 7/1/2050.  (SD2)

Beginning 7/1/2026, authorizes the use of hemp-derived feed ingredients in certain commercial animal feeds.  Authorizes the use of hemp and hemp-derived feed ingredients in commercial feed for livestock.  Requires the Department of Agriculture and Biosecurity to adopt rules.  Effective 7/1/2050.  (SD2)

Requires the Department of Agriculture and Biosecurity to use consistent units of measurement in its summary to the public on the amounts of restricted use pesticides applied.  Beginning 1/1/2027, establishes a one-half mile buffer zone for pesticides around schools during normal school hours and state and county public parks.  Establishes certain exemptions.  Effective 7/1/2050.  (SD2)

RELATING TO JURISDICTION.

Amends the factors a family court is required to consider in deciding whether the court may waive jurisdiction over a minor or adult held for criminal proceedings.  Preserves the family court's jurisdiction over a minor transferred for criminal proceedings for subsequent acts that would otherwise be within the family court's jurisdiction.  Requires the family court to retain jurisdiction over a minor if the court finds by clear and convincing evidence that the minor was trafficked, sexually abused, or raped by the alleged victim in the case before or during the commission of the alleged offense.  (SD1)

RELATING TO EMERGENCY PREPAREDNESS COMMUNICATIONS.

Requires the Hawaii Emergency Management Agency to develop and implement a statewide public education and communications program to promote household emergency preparedness consistent with the Agency's 14-day essential supplies recommendation.  Requires the Governor or mayor of a county to provide an American Sign Language interpreter during each official announcement broadcast via television or the Internet during a state of emergency.  Requires the Governor or mayor of a county to ensure, to the fullest extent possible, that the American Sign Language interpreter's face, body, arms, and hands are visible during the broadcast.  Requires the Governor or mayor of a county to provide a standardized pool feed that includes the American Sign Language interpreter in a picture-in-picture window not less than one quarter the size of the primary video and not blocked or covered by captions, graphics, or other on-screen tax.  Requires annual reports to the Legislature.  Appropriates funds.  Effective 7/1/2050.  (SD2)

RELATING TO COLLECTIVE BARGAINING.

Repeals the prohibition placed on certain employees exempt from Civil Service Law from grieving a suspension or discharge.  Allows any employee who is a member of an appropriate bargaining unit to grieve any disciplinary action, unless prohibited by the applicable collective bargaining agreement.  Effective 1/1/2077.  (SD2)

Allows impasses and disputes relating to the amounts of State and county contributions to the Hawaii Employer-Union Health Benefits Trust Fund to be resolved by arbitration.  Repeals the prohibition against strikes by members of bargaining units on the issue of the amounts of State and county contributions to the Trust Fund.  Effective 1/1/2077.  (SD1)

Authorizes the Agribusiness Development Corporation to acquire by condemnation any real property or interest in real property, under certain conditions.  Prohibits any real property acquired by the Corporation by condemnation from subsequently being transferred or taken for any other public use without the Corporation's consent.  Effective 7/1/2050.  (SD1)

Authorizes the Department of Agriculture and Biosecurity to declare an emergency quarantine when it has been reasonably determined that there is a threat to agriculture or the environment in the State.  Authorizes the Department to halt operations related to or within the affected area for ninety-six hours, subject to extension by vote of the Board of Agriculture and Biosecurity.  Authorizes the Department to quarantine any business or other area that is known or reasonably suspected to be infested or infected with any pest.  Requires the Department to provide certain notices to affected farmers and provide compensation.  Authorizes the Department to establish interim rules governing the transportation of any material into and within the State known to harbor or transport a high-impact invasive species or pest.  (SD2)

Establishes the procedure that a court of the State shall follow upon the reversal or vacation of an individual's judgment or conviction on grounds consistent with innocence, and where the charges were dismissed.  Requires the Department of Corrections and Rehabilitation to notify the Department of Human Services to assign a case manager to a petitioner upon the petitioner's release.  Requires the State to provide medical coverage to a person for a certain duration upon the reversal or vacation of a person's judgment of conviction on grounds consistent with innocence and where the charges were dismissed.  Clarifies that any benefits that a petitioner is qualified for, including any benefits under chapter 346, HRS, continue until the petitioner is gainfully employed or no longer qualifies for the benefits.  Requires the Department of Corrections and Rehabilitation to provide a state identification card to a petitioner upon release.  Requires the Department of the Attorney General to submit an annual report to the Legislature.  Clarifies that a person whose judgment of conviction was reversed or vacated, or who was pardoned, on grounds consistent with innocence, and where the charges were dismissed, may petition for compensation.  Requires the State to prove by a preponderance of evidence that the reversal or vacation of the order of conviction for a petitioner, or the pardoning of the petitioner, was inconsistent with innocence.  Specifies that any award under chapter 661B, HRS, is only to settle claims with the State and not any third party.  Prohibits the Attorney General from offsetting third-party claims against an award made under chapter 661B, HRS.  Effective 1/1/2525.  (SD2)
