RELATING TO TRANSIT-ORIENTED DEVELOPMENT. Requires the development of transit-supportive densities to be allowed in any county-designated transit-oriented development area. Prohibits the counties from enacting an ordinance, rule, regulation, development standard, zoning provision, or other land use control that restricts the development of transit-supportive densities. Effective 7/1/3000. (HD1)

RELATING TO HOUSING. Deems a county inclusionary mandate as a form of development exaction and treats the mandate as a housing affordability impact fee, with certain exemptions. Prohibits a county from adopting, amending, or enforcing an inclusionary mandate or inclusionary mandates for residential or mixed-use development, under certain circumstances. Establishes additional requirements for a needs assessment study for a county-imposed inclusionary mandate. Establishes a criterion that allows luxury residential projects or projects that receive certain discretionary value increases to be subject to inclusionary mandates. Effective 7/1/3000. (HD1)

RELATING TO OFF-SITE CONSTRUCTION. Implements certain recommendations of the SPEED Task Force. Establishes a working group within the State Building Code Council to develop proposals for an off-site construction program. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO PUBLIC SCHOOL LAND TRANSFER. Amends Act 307, SLH 2022, to revise tax map key numbers and the conveyance process by which identified properties are to be conveyed to the Department of Education. Effective 7/1/3000. (HD1)

RELATING TO REAL ESTATE TRANSACTIONS. Requires a seller of real property adjacent to the shoreline, and the seller's agent, to disclose and include in all advertisements certain shoreline erosion issues related to the parcel.

RELATING TO TOWING PRACTICES. Establishes a Uniform Towing Practices for Public Parking Facilities Working Group within the Department of Transportation to examine existing state and county laws, ordinances, rules, and administrative practices relating to towing from public parking facilities and develop recommendations for uniform standards applicable to towing from state and county parking facilities. Requires a report to the Legislature. (HD1)

RELATING TO HAWAIIAN AFFAIRS. Amends the membership and responsibilities of the Public Land Trust Working Group established under Act 226, SLH 2022. Requires the Working Group to submit four reports to the Legislature: by 8/1/2027, a first interim report regarding Act 178, SLH 2006, financial reporting and accounting; by 12/1/2027, a second interim report regarding the public land trust inventory; by 6/1/2028, a third interim report that includes a preliminary draft of findings and recommendations regarding Act 178 financial reporting and accounting and the public land trust inventory; and by 10/1/2028, a final report that includes proposed legislation. Authorizes the Office of Hawaiian Affairs to provide administrative support to the Working Group in coordination with a third-party consultant.

RELATING TO AGRICULTURAL TOURISM. Establishes statewide, uniform standards to promote agricultural tourism activities in the State for all counties that have adopted an agricultural tourism ordinance. Requires agricultural tourism activities to be registered by the county planning department. Requires agricultural tourism activities to coexist with an agricultural activity on a farming operation and to be accessory and secondary to the principal farming operation. Establishes a process for the termination of an authorization for agricultural tourism activities upon a determination that the agricultural activity has ceased. Requires report to the Legislature. Effective 7/1/3000. (HD1)

RELATING TO ISLAND BURIAL COUNCILS. Transfers the appointment authority for Island Burial Council members from the Governor and Senate to the Board of Trustees of the Office of Hawaiian Affairs.

RELATING TO LAND USE. Between 7/1/2026 and 12/31/2028, authorizes each county planning commission to petition the Land Use Commission for a district boundary amendment to reclassify certain lands within the agricultural district to the rural district through the declaratory ruling process.

RELATING TO FRESHWATER WATERWAYS. Prohibits residing in, on, or within fifty feet of a freshwater waterway. Authorizes state and local law enforcement agencies, including county police, the Department of Land and Natural Resources' Conservation and Resources Enforcement Program, and the Department of Law Enforcement, to enforce the prohibition.

The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
