Status

RELATING TO TAXATION.

Establishes the alternative transportation options tax credit for employers that offer transportation demand management strategies to employees who commute using a method other than single occupancy vehicle.  Authorizes rulemaking.

RELATING TO CONSUMER PROTECTION.

Prohibits auto manufacturers and dealers from charging a post-sale subscription fee for hardware that is already installed at the time of purchase.  Establishes penalties and fines.

RELATING TO BIODIESEL.

Requires the Director of Business, Economic Development, and Tourism to adopt rules to require that diesel fuel sold in the State for use in on-highway diesel-powered motor vehicles contains no less than five per cent biodiesel by volume.

RELATING TO CARBON OFFSETS.

Requires the Department of Transportation to assist and enable a person to voluntarily purchase a verified carbon offset for greenhouse gas emissions resulting from the person's air travel to or from an airport in the State.

RELATING TO COMMERCIAL DRIVER LICENSING.

Requires that state and county firefighters exempt from commercial driver licensure be subject to an alcohol and substance abuse policy for employees that is equivalent to, or exceeds the provisions of, the safety and health standards established by the United States Department of Transportation for holders of commercial driver's licenses.

HB 2334

Status

RELATING TO TRANSPORTATION ENVIRONMENTAL REVIEW.

Authorizes the Department of Transportation to assume responsibilities under the National Environmental Policy Act of 1969 for highway projects, as well as railroad, public transportation, or multimodal projects within the State, allowing streamlined environmental reviews.  Provides a limited waiver of sovereign immunity to comply with federal requirements under 23 U.S.C. §§326 and 327.

Status

RELATING TO FEDERAL MILITARY INSTALLATIONS.

Authorizes the Department of Transportation to enter into agreements with the United States Department of Defense for the provision of services at federal military installations, provided that only federal funds are used and title 23 United States Code federal highway funds are excluded.  Authorizes charging an administrative fee.

Status

RELATING TO MOTOR VEHICLES.

Prohibits, for sales or offers for sale of new motor vehicles, markups in excess of five per cent of the manufacturer's suggested retail price, markups in excess of $0 when specified in a proclamation declaring a state of emergency, and charges added to rates not based on the underwriting risk or credit characteristics of the consumer when dealers directly finance motor vehicle purchases.  Requires dealers to retain records for markups for a period of no less than three years.

RELATING TO TOWING PRACTICES.

Establishes uniform standards for parking enforcement and towing practices on state and state‑leased lands, including notice requirements, disability protections, consumer payment safeguards, and public reporting.

Appropriates moneys to the Department of Transportation to install all-way crosswalks at sites abutting school properties.

Beginning 1/1/2027, requires each county to implement fare-free access to its public transportation systems.  Establishes the Fare-Free Public Transportation Tax and Dividend Special Fund.  Increases the Environmental Response, Energy, and Food Security Tax on petroleum products to fund fare-free public transportation.

RELATING TO PUBLIC TRANSIT.

Establishes a two-year Keiki Fare-Free Transit Pilot Program on Oahu and Kauai.  Appropriates funds.

Prohibits the sale, offer for sale, lease, rental, distribution, possession, or operation of a high-speed electric bicycle.  Establishes penalties.

HB 1694

Status

RELATING TO SUSTAINABLE AVIATION FUEL TAX CREDIT.

Establishes a tax credit for sustainable aviation fuel distribution in Hawaii to reduce greenhouse gas emissions. Provides $1 per gallon, increasing by 2 cents per additional 1 per cent emissions reduction, up to $2 per gallon.  Caps total credits at $20,000,000 annually, with carryover provisions. Requires reporting to ensure transparency and compliance. Applies to taxable years after December 31, 2025, and sunsets on December 31, 2035.

RELATING TO RENEWABLE FUEL.

Expands the provisions of the renewable fuels production tax credit.

RELATING TO A CLEAN FUEL STANDARD.

Requires the Department of Transportation to adopt rules by 1/1/2028 governing a clean fuel standard for alternative fuels in the State.

Status

RELATING TO AUTONOMOUS VEHICLES.

Requires an automated vehicle used by a motor carrier to transport passengers commercially to have a human supervisor present in the vehicle.  Establishes an income tax credit to incentivize the training of supervisors for autonomous vehicles.  Sunsets 12/31/2038.

Status

RELATING TO PUBLIC TRANSIT.

Establishes within the Department of Transportation a fare-free youth transit program, to be coordinated with the counties.  Establishes a fare-free youth transit program special fund.  Requires biannual evaluations of the new program and special fund.  Allocates moneys from the environmental response, energy, and food security tax to the fare-free youth transit program special fund.  Appropriates moneys into and out of the fare-free youth transit program special fund.  Requires reports to the Legislature.

Status

RELATING TO TRANSPORTATION.

Requires and appropriates funds for the Department of Transportation to establish a pilot program to offer fully subsidized public transit passes for department employees.
