RELATING TO STUDENTS WITH DISABILITIES.

Authorizes the inclusion of language addressing individualized accommodations and supports during emergency situations and evacuations in individualized education programs for students with disabilities.  Requires support and guidance from the Department of Education.  Effective 7/1/3000.  (HD1)

RELATING TO VETERANS.

Repeals the specific deadline by which the Maui State Veterans Home must be assimilated into a state agency having a Maui affiliation.  Requires the transfer of the Maui State Veterans Home to be completed as soon as practicable.  Effective 7/1/3000.  (HD1)

RELATING TO SPECIAL LICENSE PLATES.

Authorizes the issuance of special number plates for members of the Hawaii Civil Air Patrol.  Effective 7/1/3000.  (HD1)

RELATING TO WRONGFUL IMPRISONMENT.

Establishes the procedure that a trial court shall follow upon the reversal or vacation of an individual's judgment of conviction on grounds consistent with innocence, and where the charges were dismissed.  Requires the State to pay advance compensation to any petitioner who was convicted in a court of the State, imprisoned for at least one year, and whose judgment of conviction was reversed or vacated, or was pardoned, on grounds consistent with innocence.  Requires the Comptroller to issue a warrant for payment of advance compensation to a petitioner.  Requires the Adult Client Services Division or a contracted community-based agency to assign a case manager to a petitioner upon the petitioner's release.  Requires the State to provide medical coverage to a person for a certain duration upon the reversal or vacation of the person's judgment of conviction on grounds consistent with innocence and where the charges were dismissed.  Requires the Department of the Attorney General to submit an annual report to the Legislature.  Clarifies eligibility to seek compensation for individuals whose judgment of conviction was reversed or vacated, or who were pardoned, on grounds consistent with innocence, and where the charges were dismissed.  Shifts the burden of proof to the State to prove by a preponderance of evidence that the reversal or vacating of the judgment of conviction for a petitioner, or the pardoning of the petitioner, was inconsistent with innocence.  Effective 7/1/3000.  (HD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
