Status

RELATING TO CAMPAIGN CONTRIBUTIONS.

Prohibits state or county contractor's compensated officers and any officer's immediate family, with contracts exceeding the small purchase threshold pursuant to section 103D-305, Hawaii Revised Statutes, from contributing to candidate or noncandidate committees, candidates, or any person for any political purpose for the duration of the contract.  Prohibits grantees, grantees' compensated officers and grantees' officer's immediate family, with grants of more than $100,000, from contributing to candidate or noncandidate committees, candidates, or any person for any political purpose for the duration of the grant.  Requires any unlawful contribution to be returned to the contributor or it will escheat to the Hawaii election campaign fund.  Requires the disclosure of names of any compensated officers and immediate family members of a state or county contractor or grantee for contracts or grants exceeding a certain amount.  Requires the Campaign Spending Commission to make available to candidate and noncandidate committees the disclosed names in a password-protected database.  Appropriates moneys.  Effective 7/1/2050.  (SD2)

RELATING TO STANDARDS OF CONDUCT.

Prohibits a state agency from entering into any contract to procure or dispose of goods or services, or for construction, with any business that is owned or operated, or in which a controlling interest is held, by a relative or household member of a director or deputy director of a principal state department.  Requires directors, acting directors, and deputy directors of a principal state department to be responsible for ensuring that all contracts entered into by the department comply with a provision in the State's Code of Ethics governing conduct relating to contracts.  Requires any violation to be assessed against the director, acting director, or deputy director of the department at the time the violation occurred.  Effective 1/1/2525.  (SD1)

RELATING TO CRIMINAL JUSTICE REFORM.

Establishes factors under which officers may arrest and detain persons without a warrant for petty misdemeanors and violations, and requires officers to document the justification for the arrests.  Amends the circumstances under which officers may issue citations in lieu of arrest.  Requires officers to issue citations in lieu of arrest for certain petty misdemeanors and violations.  Requires the Judiciary to promulgate a standardized citation form and updates the required information for citations.  Requires citations be visible on an offender's criminal record.  Effective 7/1/2050.  (SD2)

Status

PROPOSING AN AMENDMENT TO ARTICLE XVII, SECTION 3 OF THE HAWAII STATE CONSTITUTION TO SPECIFY THAT THE STANDARD FOR VOTER APPROVAL OF A CONSTITUTIONAL AMENDMENT PROPOSED BY THE LEGISLATURE IS A MAJORITY OF ALL THE VOTES TALLIED UPON THE QUESTION.

Proposes to amend article XVII, section 3, of the Hawaii State Constitution regarding the standard for ratification of a constitutional amendment proposed by the Legislature, to provide that proposed amendments shall be effective only if approved at a general election by a majority of all the votes tallied upon the question.  Effective 7/1/2050.  (SD2)

Establishes a statute of limitations of nine years for a bribery offense.

RELATING TO THE RETENTION OF BIOLOGICAL EVIDENCE.

Specifies the types of cases in which evidence must be retained post-conviction and the process by which evidence may be disposed of earlier than the standard period of retention, which includes a procedure for defendants to oppose the disposal of biological evidence by filing an objection with the court.  Provides that upon the motion of a defendant or prosecutor or on the court's own motion, the court may order retention of biological evidence in any felon case for a certain period under certain circumstances.  Effective 3/22/2075.  (SD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.

 

For remote testifiers, the House will not be responsible for bad connections on the testifier's end.
