Status

RELATING TO THE MOTION PICTURE, DIGITAL MEDIA, AND FILM PRODUCTION INCOME TAX CREDIT.

Increases the amount of the motion picture, digital media, and film production income tax credit to 27% of qualified production costs in counties with a population of over 700,000 and 32% in counties with a population of 700,000 or less.  Requires each taxpayer claiming the tax credit to submit an independent third-party certification verifying certain information to the Department of Business, Economic Development, and Tourism.  Excludes qualified productions that incur at least $60,000,000 of qualified production costs from the per-production cap amount of $17,000,000.  Changes the aggregate cap amount to an unspecified amount.  Defines "streaming platform" and amends the definition of "qualified production" to include certain streaming productions.  Extends the repeal date of the tax credit to 1/1/2038.  Effective 7/1/2050.  (SD2)

RELATING TO THE FILM INDUSTRY.

Establishes the Hawaii Film Commission within the Department of Business, Economic Development, and Tourism for administrative purposes only and transfers the rights, powers, functions, and duties of the Hawaii Film Office to the Commission.  Establishes the Film Industry Development Special Fund.  Excludes media and film from the definition of creative industries and renames the Hawaii Film and Creative Industries Development Special Fund as the Hawaii Creative Industries Development Special Fund.  Amends the sources of moneys to be deposited into the Hawaii Creative Industries Development Special Fund, including requiring all revenues, fees, and charges from the processing of the Motion Picture, Digital Media, and Film Production Income Tax Credit to be deposited into the Film Industry Development Special Fund, rather than the Hawaii Creative Industries Development Special Fund.  Allows the Creative Industries Development Special Fund to be used for the support and development of facilities and other initiatives to grow the State's creative industries.  Requires the Governor to appoint Commission members, the Director of Business, Economic Development to appoint the Executive Director of the Commission, and the Executive Director to hire staff by 12/31/2027.  Requires annual reports to the Legislature.  Appropriates funds.  Effective 7/1/2050.  (SD1)

Expands the allowable uses of Hawaii Technology Development Corporation grant funds to include providing grants to applicants for qualifying federal research and development awards and matching funds for recipients of those awards and related contracts.  Effective 7/1/2050.  (SD1)

Status

RELATING TO STATE ENTERPRISE ZONES.

Expands the definition of "eligible business activity" to include certain research and development activities and information technology design and production services.  Authorizes the Department of Business, Economic Development, and Tourism to declare up to two census tracts in the State that contain an innovation enterprise to be designated as an enterprise zone, subject to the Governor's approval.  Requires DBEDT to conduct an in-house comprehensive review, in consultation with the Department of Taxation, of the State Enterprise Zones Program established under chapter 209E, HRS.  Requires a report to the Legislature.  Effective 7/1/2050.  (SD1)

RELATING TO PROCUREMENT.

Establishes the Small Business Procurement Program and Small Business Procurement Coordinator position permanently in the State Procurement Office.  Repeals the Small Business Assistance Initiative established in Act 168, Session Laws of Hawaii 2022, effective 1/1/2525.  Appropriates funds.  Effective 7/1/2525.  (SD1)

RELATING TO PUBLIC PROCUREMENT.

Requires purchasing agencies to apply a local preference in evaluating bids or proposals from qualified Hawaii bidders or offerors who submit a timely preference certification.  Establishes criteria for a bid or proposal to qualify for a local preference.  Establishes requirements for the qualification and certification of Hawaii bidders and offerors.  Authorizes the false or misleading actions for the obtaining or retaining of a Hawaii bidder or offeror preference to constitute cause for debarment.  Allows the Procurement Policy Board to adopt rules.  Effective 7/1/2525.  (SD1)

RELATING TO LAW ENFORCEMENT.

Prohibits with certain exceptions, the use of facial coverings and requires visible identification by law enforcement officers and their vehicles in the performance of their duties.  Requires state and county law enforcement agencies to establish policies regarding state and county cooperation with federal civil immigration enforcement.  Prohibits law enforcement officers from prolonging a stop to inquire about a person's civil immigration status.  Establishes criminal offenses for use of a mask or facial covering by a law enforcement officer, lack of visible identification, and unauthorized civil immigration interrogation.  Effective 3/22/2075.  (SD2)

Establishes the offense of criminal property damage to critical infrastructure facilities as a class C felony.  Expands the term "critical infrastructure" to include broadband and cable networks.  Effective 9/1/2050.  (SD2)

RELATING TO CHARITABLE SOLICITATION.

Requires professional solicitors operating public collection receptacles to solicit donations of non-perishable tangible property who later re-sell the items to deposit funds with charitable organizations within a specified timeframe, provide certain information in financial reports, and prominently disclose certain information on collection receptacles.  Effective 7/1/2050.  (SD2)

Status

RELATING TO LIQUOR.

Part I:  In counties of fewer than 200,000 residents, but more than 100,000 residents, exempts the three-day temporary liquor licenses for fundraising events, known as class 10 special licenses, from any requirement to obtain fire-related clearances.  Allows applications for class 10 special licenses to be submitted electronically and for a single application to apply any fundraising event that spans multiple parcels of land owned by the same entity.  Part II:  Increases the percentage of fines assessed by all county liquor commissions that may be used to fund public liquor-related educational or enforcement programs.  Effective 3/22/2075.  (SD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
