Status

RELATING TO CONDOMINIUMS.

Requires the Condominium Education Trust Fund to be used for educational resources for condominium unit owners in condominium governance, including programs designed to improve owner understanding of association operations, reserve requirements, financial obligations, and governance rights.  Requires the Real Estate Commission to ensure the interests of condominium unit owners are represented in certain activities funded by the Condominium Education Trust Fund and to adopt rules protecting the rights of condominium unit owners for purposes of condominium governance.  Effective 7/1/2050.  (SD1)

Status

RELATING TO PHARMACY BENEFIT MANAGERS.

Establishes certain requirements for pharmacy benefit managers, other than health maintenance organizations that own and operate their own pharmacies, that reimburse contracting pharmacies for drugs on a maximum allowable cost basis.  Allows contracting pharmacies to reverse and rebill claims if a maximum allowable cost is denied on appeal.  Authorizes the Insurance Commissioner to assess fines for violations.  Appropriates funds.  Effective 1/30/2050.  (HD1)

Status

RELATING TO HEALTH INSURANCE.

Requires health insurers, mutual benefit societies, and health maintenance organizations to honor a patient's written assignment of benefits to a substance use disorder treatment provider.  Prohibits health insurance policies, plans, contracts, and agreements from including anti-assignment clauses that restrict or invalidate a patient's right to assign benefits.  Authorizes the Insurance Commissioner to adopt rules and take enforcement action to ensure compliance.  Deems violations to be unfair methods of competition and unfair or deceptive acts or practices in the business of insurance.  Requires insurers, mutual benefit societies, and health maintenance organizations to furnish an explanation of benefits to the assigned provider upon request.  Effective 1/30/2050.  (HD1)

Status

RELATING TO HEALTH INSURANCE.

Beginning 1/1/2027, requires all health insurers, mutual benefit societies, and health maintenance organizations in the State, including Medicaid managed care programs, to cover the cost of continuous glucose monitors and related supplies under certain conditions.  Allows the Departments of Health and Human Services to accept and expend funds from public and private sources to support the expansion of access to continuous glucose monitors.  Effective 1/30/2050.  (HD1)

RELATING TO SOCIAL MEDIA.

Requires a social media platform to take reasonable steps to verify the age of new and existing account holders on the social media platform.  Prohibits a social media platform from allowing individuals under sixteen years of age from creating or maintaining an account or profile, absent the express consent from a parent or legal guardian.  Makes violations an unfair or deceptive act or practice in the conduct of trade or commerce.  Effective 1/1/2077.  (HD1)

Status

RELATING TO ARTIFICIAL INTELLIGENCE.

Requires operators of conversational artificial intelligence services in the State to issue certain disclosures to account holders and users.  Requires operators to develop protocols to prevent the production of suicidal ideations in account holders and users.  Establishes protections for account holders and users of conversational artificial intelligence services.  Establishes protections for minor account holders and users of conversational artificial intelligence services.  Beginning 1/1/2028, requires operators to submit annual reports to the Department of Commerce and Consumer Affairs containing certain information.  Allows the Department of the Attorney General to bring a civil action against operators who violate certain requirements.  Establishes that violations are to be considered unfair or deceptive acts or practices.  Effective 7/1/2050.  (HD1)

Status

RELATING TO CIVIL RIGHTS.

Establishes it as an unlawful discriminatory practice for a place of public accommodation to deny a person with a disability full and equal enjoyment of information related to their services, facilities, privileges, advantages, or accommodations by requiring use of information and communication technology that is not accessible to the person.  Beginning 7/1/2027, requires each place of public accommodation with 16 or more employees to ensure that all information and communication technology used is accessible to persons with disabilities.  Beginning 7/1/2028, requires all places of public accommodations to each ensure that all information and communication technology used is accessible to persons with disabilities.  Establishes exceptions.  Effective 1/30/2050.  (SD1)

Status

RELATING TO THE POWERS OF ARTIFICIAL PERSONS.

Reaffirms that artificial persons created under state law possess only those powers that are necessary or convenient to carry out lawful business and charitable or organizational purposes, and that those powers do not include the power to spend money or contribute anything of value to influence elections or ballot measures.  Revokes all prior grants of corporate and entity powers and regrants only those powers that the State determines to be necessary or convenient to conduct lawful business under the constitution and laws of this State.  Effective 1/1/2027.  (SD2)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
