Status

RELATING TO INSURANCE FRAUD.

Increases the scope of insurance fraud and certain offenses.  Augments offenses by contractors and insurers during a declared emergency.  Clarifies the penalties for the offense of insurance fraud and the capabilities and operations of the Insurance Fraud Investigations Branch, including the annual report to the Legislature and the protection of sensitive information.  Adds protection for insurance fraud whistleblowers.  Authorizes the Insurance Commissioner to establish a centralized database for authorized agencies to track insurance fraud data.  Appropriates funds from the compliance resolution fund.  Effective 7/1/2050.  (SD2)

Status

RELATING TO DIGITAL ASSET CHARTERS.

Establishes within the Department of Commerce and Consumer Affairs' Division of Financial Institutions, beginning 1/1/2027, a digital asset charter program for licensing, regulating, and overseeing digital asset companies and digital asset business activities.  Authorizes companies that participated in the Hawaii Digital Currency Innovation Lab to temporarily continue digital asset business activities without a charter in certain circumstances.  Appropriates moneys from the compliance resolution fund.  Effective 7/1/2050.  (SD2)

Status

RELATING TO PRIVACY.

Adds definitions of "identifier" and "specified data element" and amends the definition of "personal information" for the purposes of notifying affected persons of data and security breaches under existing state law that governs the security breach of personal information.  Includes telecommunications carriers subject to and in compliance with certain federal provisions among the businesses deemed compliant with security breach notice requirements under existing state law.  Effective 7/1/2050.  (SD1)

RELATING TO CURRENCY.

Requires retail merchants to accept cash payments in in-person transactions.  Requires cash transactions to be rounded up or down to the nearest five cents.  Requires cash transactions that total $0.01 or $0.02 to be rounded up to $0.05.  Exempts transactions in which payment is made by demand or negotiable instrument, electronic fund transfer, check, gift card, money order, credit card, or other like instrument or method.  Effective 7/1/2050.  (SD1)

Status

RELATING TO CONDOMINIUMS.

Clarifies that condominium associations that have obtained title to a unit through foreclosure may retain rental income received prior to the appointment of a commissioner in a subsequent foreclosure; provided that the association may be required by a court to remit rental income received after the appointment of a commissioner to be held until an order of distribution is entered by the court.  Effective 7/1/2050.  (SD1)

Status

RELATING TO CIVIL RIGHTS.

Establishes it as an unlawful discriminatory practice for a place of public accommodation to deny a person with a disability full and equal enjoyment of information related to their services, facilities, privileges, advantages, or accommodations by requiring use of information and communication technology that is not accessible to the person.  Beginning 7/1/2027, requires each place of public accommodation with 16 or more employees to ensure that all information and communication technology used is accessible to persons with disabilities.  Beginning 7/1/2028, requires all places of public accommodations to each ensure that all information and communication technology used is accessible to persons with disabilities.  Establishes exceptions.  Effective 1/30/2050.  (SD1)

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
