RELATING TO THE WORKERS' COMPENSATION LAW. Repeals the requirement that health care providers' forms be filed with the Director of Labor and Industrial Relations (DLIR) in triplicate. Clarifies the way a physician transmits a treatment plan to an employer. Repeals a reference to the employer's receipt of a vocational rehabilitation plan by mail. Repeals the option of employers to submit reports to the DLIR via United States mail. Repeals the option of health care providers to provide reports to the DLIR or employer via mail. Effective 7/1/3000. (HD1)

RELATING TO THE HAWAII OCCUPATIONAL SAFETY AND HEALTH LAW. Repeals the requirement that the Department of Labor and Industrial Relations regulate hoisting machines and certify their operators and the Hoisting Machine Operators Advisory Board, including its rules requiring a separate state crane operator certificate. Allows additional time for the Director of Labor and Industrial Relations to complete an investigation of a discharge or discrimination complaint pertaining to employees exercising rights under the Occupational Safety and Health Law without formal extension. Effective 7/1/3000. (HD1)

RELATING TO WORKERS' COMPENSATION. Repeals the authorization of a physician to transmit a treatment plan by mail or facsimile and the requirement that the physician submit it to an address or facsimile number provided by the employer. Requires an employer to file a response, either accepting or objecting to a treatment plan, within seven days of receipt. Imposes a monetary penalty if an employer does not file a response within the seven-day period, unless the Director of Labor and Industrial Relations determines there was good cause in the delay. Clarifies that a treatment plan is deemed accepted if an employer fails to file certain documents within the seven-day period. Effective 7/1/3000. (HD1)

RELATING TO THE HAWAII EMPLOYMENT SECURITY LAW. Amends the qualifications for unemployed individuals who are able to receive unemployment benefits. Beginning 4/1/2027, removes the two-year limitation on the recoupment of overpayments. Beginning 4/1/2027, requires the Department of Labor and Industrial Relations to assess and collect a service charge for dishonored unemployment insurance assessments. Beginning 4/1/2027, specifies that employers must report separation and wage information within five calendar days of notice being sent, whether by mail or electronic notification. Beginning 4/1/2027, increases the penalty for failure to report separations or wages and for failure to file or for filing insufficient wage reports. Effective 7/1/3000. (HD1)

RELATING TO EMPLOYMENT EARNINGS. Requires hourly rate or salary ranges to be disclosed on job listings for full-time, part-time, temporary, or seasonal employees. Removes the exemption for employers having fewer than fifty employees. Effective 7/1/3000. (HD1)

RELATING TO HOMEMADE FOOD PRODUCTS. Requires the Department of Health to adopt rules for the regulation of farm kitchens producing homemade food products that are no more stringent than those for home kitchens producing homemade food products. Effective 7/1/3000. (HD1)

RELATING TO HEALTH CARE. Prohibits health care facilities, health care providers, and emergency medical services from furnishing medical debt to a consumer credit reporting agency. Prohibits consumer credit reporting agencies from reporting or maintaining medical debt information in the file on a consumer. Effective 7/1/3000. (HD1)

RELATING TO INSURANCE. For policies, contracts, plans, and agreements issued or renewed after 12/31/2026, requires insurers, mutual benefit societies, and health maintenance organizations to provide coverage for standard fertility preservation services for persons undergoing medically necessary treatment that may cause iatrogenic infertility. Clarifies that the Department of Health is to presume both the recommendations by the American Academy of Pediatrics and the recommendations by the Advisory Committee on Immunization Practices of the United States Department of Health and Human Services constitute the prevailing medical standard for child health supervision services for purposes of health insurance coverage. RELATING TO TELEHEALTH. Authorizes out-of-state physicians who are licensed and in good standing in the state in which they reside to provide telemedicine services in Hawaii via telehealth, under certain conditions. Clarifies that a physician-patient relationship may be established with an out-of-state physician via telehealth under certain circumstances. Effective 7/1/3000. (HD1)

RELATING TO THE STATE HEALTH PLANNING AND DEVELOPMENT AGENCY. Amends the functions and responsibilities of the State Health Planning and Development Agency. Adds a new definition of "health care." Amends the exemption threshold for bed changes to up to thirty per cent of existing licensed bed types. Exempts the Department of Health from certificate of need requirements. Effective 7/1/3000. Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony received after this time will be stamped late and left to the discretion of the chair to consider. While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony.
The chair may institute a per-testifier time limit.
Committees meeting in the morning must adjourn prior to the day's Floor Session. Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments. However, written submissions will be considered by the committee.
Please refrain from profanity or uncivil behavior. Violations may result in ejection from the hearing without the ability to rejoin.
