Sir:

 

     Your Committees on Public Safety and Military Affairs and Energy and Intergovernmental Affairs, to which was referred S.C.R. No. 25 entitled:

 

"SENATE CONCURRENT RESOLUTION OPPOSING CONDEMNATION OR THREATS OF CONDEMNATION BY THE FEDERAL GOVERNMENT TO TAKE CONTROL OF POHAKULOA AND ANY STATE LAND,"

 

beg leave to report as follows:

 

     The purpose and intent of this measure is to oppose condemnation or threats of condemnation by the federal government to take control of Pohakuloa and any state land.

 

     Your Committees received testimony in support of this measure from the Office of Hawaiian Affairs, Hawaii Organization for Progress and Equity, Kiaʻi Iwi Alakaʻi, and twelve individuals.

 

     Your Committees find that Pohakuloa Training Area is comprised of crown and government lands, both of which are included in the public land trust protected by article XII, section 4, of the Hawaii State Constitution.  The lands on which Pohakuloa Training Area is located are important, not only because they are part of the State's public land trust, but also because they are of great cultural and historical significance.  Any use of condemnation by the federal government to circumvent existing legal obligations, including obligations to complete environmental review of any proposed use and retention of Pohakuloa Training Area under chapter 343, Hawaii Revised Statutes, is inconsistent with both the letter and the spirit of the Hawaii Admissions Act and the trust responsibilities that the federal government owes to the residents of the State.  This measure helps preserve the State's role in decisions on Pohakuloa Training Area by articulating a clear position in opposition to federal condemnation.

 

     As affirmed by the records of votes of the members of your Committees on Public Safety and Military Affairs and Energy and Intergovernmental Affairs that are attached to this report, your Committees concur with the intent and purpose of S.C.R. No. 25 and recommend that it be referred to your Committee on Judiciary.
