Sir and Madam:

 

     Your Committee on Conference on the disagreeing vote of the Senate to the amendments proposed by the House of Representatives in S.B. No. 888, S.D. 2, H.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO CONSUMER PROTECTION,"

 

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

 

     The purpose of this measure is to:

 

     (1)  Prohibit operators of smart household security devices from sharing user data with law enforcement agencies unless the user consents, the law enforcement agency obtains a judicial warrant, or there is an emergency situation involving a clear and present danger of imminent death or great bodily harm; and

 

     (2)  Prohibit operators from requiring users to consent to the sharing of data with law enforcement agencies as a condition of using a smart household security device.

 

     Your Committee on Conference finds that the integration of smart household security devices into homes has created new vulnerabilities regarding the privacy of personal data and the potential for government overreach.  Your Committee on Conference further finds that clear limitations are necessary to ensure that smart household security device data is protected from disclosure unless specifically authorized by the user or required by law.  This measure establishes privacy safeguards and protects consumers by ensuring that smart household security device users are in control of how their data is shared and that data is disclosed only in authorized circumstances.

 

     Your Committee on Conference has amended this measure by:

 

     (1)  Inserting language to establish that a violation of the measure's provisions shall be deemed an unfair or deceptive act or practice in trade or commerce in violation of chapter 480, Hawaii Revised Statutes;

 

     (2)  Inserting language to authorize the Attorney General to bring an action to recover certain relief;

 

     (3)  Inserting an effective date of July 1, 2026; and

 

     (4)  Making technical, nonsubstantive amendments for the purposes of clarity and consistency.

 

     As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of S.B. No. 888, S.D. 2, H.D. 2, as amended herein, and recommends that it pass Final Reading in the form attached hereto as S.B. No. 888, S.D. 2, H.D. 2, C.D. 1.
