Sir:

 

     Your Committees on Ways and Means and Commerce and Consumer Protection, to which was referred S.B. No. 3263, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO THE UNIVERSITY OF HAWAII,"

 

beg leave to report as follows:

 

     The purpose and intent of this measure is to establish the name, image, likeness endowment fund, which will be administered by the University of Hawaii to compensate student athletes.

 

     Your Committees received written comments in support of this measure from the University of Hawaii and three individuals.

 

     Your Committees received written comments on this measure from the Department of the Attorney General and the Grassroot Institute of Hawaii.

 

     Your Committees find that this measure will create a long‑term, sustainable revenue stream for name, image, and likeness compensation that will help the University of Hawaii to recruit and retain elite student athletes.

 

     Your Committees have amended this measure by:

 

     (1)  Designating the fund as a trust fund and renaming it accordingly;

 

     (2)  Specifying that the annual reports submitted by the University of Hawaii contain a list of teams with student athletes compensated by the name, image, likeness endowment trust fund, instead of a list of student athletes compensated by the trust fund; and

 

     (3)  Changing the effective date to July 1, 2050, to facilitate further discussion on the measure.

 

     As affirmed by the records of votes of the members of your Committees on Ways and Means and Commerce and Consumer Protection that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 3263, S.D. 1, as amended herein, and recommend that it pass Third Reading in the form attached hereto as S.B. No. 3263, S.D. 2.
