Madame:
Your Committee on Judiciary & Hawaiian Affairs, to which was referred S.B. No. 3262, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO EDUCATION,"
begs leave to report as follows:
The purpose of this measure is to:
(1) Require the Hawaii Teacher Standards Board to submit three nominees for its Executive Director to the Board of Education; and
(2) Require the Board of Education to appoint an Executive Director from the nominees on the list, subject to the advice and consent of the Senate.
Your Committee received testimony in support of this measure from the Hawaiʻi State Teachers Association and six individuals. Your Committee received testimony in opposition to this measure from the Hawaiʻi Teachers Standards Board. Your Committee received comments on this measure from the Board of Education.
Your Committee finds that clarifying the appointment and confirmation process for the Executive Director of the Hawaii Teacher Standards Board promotes transparency, accountability, and consistency in governance. Your Committee further finds that requiring the Board of Education to appoint an executive director from a list of nominees submitted by the Board, subject to the advice and consent of the Senate, appropriately reinforces legislative oversight while preserving the Board's role in executive selection. Your Committee believes that this measure will strengthen public confidence in the administration of education-related agencies.
Your Committee has amended this measure by changing the effective date to July 1, 3000, to encourage further discussion.
As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 3262, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 3262, S.D. 1, H.D. 1.
