Madame:

 

     Your Committee on Transportation, to which was referred S.B. No. 3215 entitled:

 

"A BILL FOR AN ACT RELATING TO HARBOR SAFETY,"

 

begs leave to report as follows:

 

     The purpose of this measure is to repeal the sunset provisions of Act 236, Session Laws of Hawaii 2024, thereby making permanent the requirement that the Department of Transportation ensure that the securing of mooring lines from vessels to commercial docks, wharves, piers, quays, and landings be performed by labor subject to collective bargaining.

 

     Your Committee did not receive any written testimony on this measure.

 

     Your Committee finds that Act 236, Session Laws of Hawaii 2024 (Act 236), established requirements for mooring operations at the State's commercial harbors to improve safety, protect harbor infrastructure, and ensure the reliable movement of critical goods, including food supplies.  These requirements help safeguard the physical integrity and operational stability of Hawaii's commercial harbor system, which is essential to the State's economy and supply chain.  However, the provisions established by Act 236 are currently subject to a sunset date, creating uncertainty for harbor operations and workforce planning.  This measure repeals the sunset provision to ensure the continued implementation of these harbor safety requirements and provide long-term operational certainty for the State's commercial harbors.

 

     Your Committee has amended this measure by:

 

     (1)  Changing the effective date to July 1, 3000, to encourage further discussion; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 3215, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 3215, H.D. 1, and be referred to your Committee on Labor.
