Sir:

 

     Your Committee on Ways and Means, to which was referred S.B. No. 3157 entitled:

 

"A BILL FOR AN ACT RELATING TO TRANSPORTATION,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to optimize the use of moneys in the automated speed enforcement systems

program special fund.

 

     Specifically, the measure amends automated speed enforcement systems program special fund by:

 

     (1)  Repealing existing statutory language requiring fines deposited into the fund to be expended in the county in which the fine was imposed; and

 

     (2)  Requiring, on June 30 of each year, that all unencumbered and unexpended moneys in excess of $12,000,000 in the fund lapse to the credit of the state general fund.

 

     Your Committee received written comments in support of this measure from the Department of Transportation and one individual.

 

     Your Committee finds it appropriate to repeal current county‑specific expenditure restrictions on moneys in the automated speed enforcement systems program special fund, as those restrictions prevent the Department of Transportation from effectively addressing traffic issues in the State.  Your Committee also finds that redirecting excess moneys from the automated speed enforcement systems program special fund to the general fund will grant the State some flexibility in the use of those moneys.

 

     As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 3157 and recommends that it pass Third Reading.
