Sir:

 

     Your Committee on Transportation, to which was referred S.B. No. 3153 entitled:

 

"A BILL FOR AN ACT RELATING TO TRANSPORTATION,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to:

 

     (1)  Authorize the Department of Transportation to designate airport special district zones within airports statewide; and

 

     (2)  Add a new section to the Hawaii Revised Statutes to help prevent unauthorized access and enhance security.

 

     Your Committee received testimony in support of this measure from the Department of Transportation; Airlines Committee of Hawaii; Alaska Airlines and Hawaiian Airlines; Airlines for America; Blind Vendors Ohana, Inc.; and one individual.

 

     Your Committee finds that as a federally obligated recipient of airport grants, the Department of Transportation must maintain compliance with several grant assurances.  Grant Assurance #19 requires that recipients must not cause or permit any activity or action that interferes with the use of the airport or its facilities.  However, existing law does not allow the Department of Transportation to prohibit or remove harmful and disruptive individuals from airport property.  This measure will ensure the appropriate use and safe and serviceable conditions of all airport facilities in the State.

 

     Your Committee has amended this measure by making technical, nonsubstantive amendments for the purposes of clarity and consistency.

 

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 3153, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 3153, S.D. 1, and be referred to your Committee on Judiciary.
