Sir:
Your Committees on Public Safety and Military Affairs and Labor and Technology, to which was referred S.B. No. 3110 entitled:
"A BILL FOR AN ACT RELATING TO THE HAWAII NATIONAL GUARD,"
beg leave to report as follows:
The purpose and intent of this measure is to:
(1) Clarify that employees of the Hawaii National Guard youth and adult educational programs are excluded from collective bargaining; and
(2) Rename the "Hawaii National Guard Youth Challenge Program" to the "Hawaii National Guard Civil-Military Program" and codify its Hawaiian name, "Na Kula Alakaʻi".
Your Committees received testimony in support of this measure from the Department of Defense.
Your Committees find that the United States Department of Defense Civil-Military Program leverages military training resources in partnership with community organizations to enhance readiness and expand access to educational and workforce development opportunities for youth, adults, and veterans. The Hawaii National Guard currently administers these programs as the Hawaii National Guard Youth Challenge Program. Renaming the Hawaii National Guard Youth Challenge Program to the Hawaii National Guard Civil-Military Program aligns it with the United States Department of Defense program name. Additionally, exempting positions within the Hawaii National Guard Youth Challenge Academy from civil service and collective bargaining requirements will allow the Department of Defense to effectively manage federally imposed wage and personnel constraints established under the Master Youth Cooperative Agreement, the Chief of the National Guard Bureau Manual, and Department of Defense Instruction 1402.05. This measure will improve administrative efficiency by streamlining the processing and tracking of pay and personnel duties and by standardizing hiring procedures once all program positions are consolidated under a single program ID.
Your Committees have amended this measure by making technical, nonsubstantive amendments for the purposes of clarity and consistency.
As affirmed by the records of votes of the members of your Committees on Public Safety and Military Affairs and Labor and Technology that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 3110, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 3110, S.D. 1, and be referred to your Committee on Ways and Means.
