Sir:
Your Committee on Judiciary, to which was referred S.B. No. 3083, S.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO PROTECTIVE ORDERS,"
begs leave to report as follows:
The purpose and intent of this measure is to:
(1) Require notification to the security forces of each branch of the military when a protective order is issued in a case involving a military-affiliated individual; and
(2) Require the Judiciary, Department of Law Enforcement, and county police departments to establish certain policies and procedures.
Your Committee received testimony in support of this measure from the Department of Business, Economic Development, and Tourism and two individuals.
Your Committee received comments on this measure from the Judiciary.
Your Committee finds that the State is home to one of the largest per-capita military populations in the nation and that servicemembers and their families are an integral part of the State's communities. When domestic violence occurs in these households, victims must often navigate both civilian and military systems which, historically, have not had an established arrangement for communicating with one another. This measure will establish interagency policies and procedures between state and county agencies and designated military security forces to collaborate and support victims across systems that serve military and civilian populations alike.
Your Committee notes that since the introduction of this measure, the Judiciary has successfully collaborated with the Military and Community Relations Office and military stakeholders to develop the appropriate framework and procedure to effectuate the intent of this measure while taking into consideration the needs of each agency.
Accordingly,
your Committee has amended this measure by:
(1) Clarifying
that the Judiciary, county police departments, and Department of Law
Enforcement, in their implementation of certain policies and procedures, shall also consult with the
designated military security force who receives notification of any order of
protection; and
(2) Making
technical, nonsubstantive amendments for the purposes of clarity and
consistency.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 3083, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 3083, S.D. 2.
