     Your Committee on Judiciary & Hawaiian Affairs, to which was referred S.B. No. 3055, S.D. 2, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO FALSE IMPERSONATION OF UNION REPRESENTATIVES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to prohibit the false impersonation of an employee organization representative and to establish a civil cause of action and penalties for violations.

 

     Your Committee received testimony in support of this measure from the United Public Workers, AFSCME Local 646, AFL-CIO; University of Hawaii Professional Assembly; Hawaii State AFL-CIO; and Hawaii Government Employees Association, AFSCME Local 152, AFL CIO.  Your Committee received testimony in opposition to this measure from the Freedom Foundation.

 

     Your Committee finds that clear and accurate communications are essential for public employee organizations to inform their members of representation rights and collective bargaining matters.  Your Committee further finds that the false impersonation of employee organization representatives can erode trust in the collective bargaining process.  This measure deters deceptive conduct and helps safeguard public employees by preserving the integrity of lawful labor representation.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 3055, S.D. 2, H.D. 1, and recommends that it pass Third Reading.
