Sir:
Your Committee on Judiciary, to which was referred S.B. No. 2991 entitled:
"A BILL FOR AN ACT RELATING TO HIGHWAY SAFETY,"
begs leave to report as follows:
The purpose and intent of this measure is to clarify that persons whose driver's licenses have been revoked for certain alcohol-related offenses are required to undergo reexamination before the examiner of drivers may relicense the person.
Your Committee received testimony in support of this measure from the Department of Transportation, Oahu Metropolitan Planning Organization, and one individual.
Your Committee received comments on this measure from the Department of Customer Services of the City and County of Honolulu.
Your Committee finds that recent reporting from the Department of Transportation indicated a serious tendency that individuals involved in fatal crashes were operating under the influence of alcohol and without a valid driver's license. Your Committee further finds that additional protocols are required to prevent potentially dangerous drivers from immediately returning to the roadways while ensuring that they are aware of the rules and laws to operate a vehicle safely. This measure will promote a safe, efficient, and resilient transportation system.
Your
Committee has amended this measure by:
(1) Inserting language to require that a notice of administrative driver's license revocation shall include certain information;
(2) Inserting language to require that an order of administrative revocation of the privilege to operate a vessel shall include certain information; and
(3) Making technical, nonsubstantive amendments for the purposes of clarity and consistency.
As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2991, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 2991, S.D. 1.
