Sir:

 

     Your Committee on Commerce and Consumer Protection, to which was referred S.B. No. 2806 entitled:

 

"A BILL FOR AN ACT RELATING TO REAL ESTATE,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to prohibit and make it an unfair or deceptive trade practice for real estate brokers to list or offer the sale or lease of residential real estate to a limited or exclusive group of prospective buyers, real estate brokers, or real estate salespersons, with limited exceptions.

 

     Your Committee received testimony in support of this measure from the Hawaiʻi Real Estate Commission and Hawaiʻi Association of REALTORS.

 

     Your Committee finds that listing or offering residential real estate to a limited or exclusive group of prospective buyers may restrict consumer choice and fair housing.  This measure would promote equal access, safeguard fair housing principles, enhance market transparency, and authorize the Hawaiʻi Real Estate Commission to revoke the license of violators.

 


 

     Your Committee has amended this measure by:

 

     (1)  Inserting an effective date of July 1, 2050, to encourage further discussion; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity and consistency.

 

     As affirmed by the record of votes of the members of your Committee on Commerce and Consumer Protection that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2806, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 2806, S.D. 1, and be referred to your Committee on Judiciary.
