Madame:

 

     Your Committee on Judiciary & Hawaiian Affairs, to which was referred S.B. No. 2667, S.D. 1, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO TRANSPORTATION,"

 

begs leave to report as follows:

 

     The purpose of this measure is to apply the following restrictions and penalties in a county with a population of five hundred thousand or more:

 

     (1)  Prohibiting certain commercial vehicles and motor vehicles towing a vehicle or trailer from operating in the far left lane on roadways with three or more lanes moving in the same direction, subject to certain exemptions; and

 

     (2)  Establishing graduated penalties for violations of the far-left-lane restriction.

 

     Your Committee received testimony in support of this measure from the Department of Transportation.  Your Committee received comments on this measure from the Judiciary.

 

     Your Committee finds that clearly defining lane-use restrictions for oversized commercial vehicles, along with specified exceptions, provides enforceable standards that promote orderly traffic flow while preserving necessary operational flexibility.  Your Committee further finds that establishing graduated penalties enhances compliance and fairness, and that limiting the application of this section to counties with populations of five hundred thousand or more ensures the law is reasonably tailored to areas with greater traffic density and enforcement capacity.

 

     Your Committee has amended this measure by:

 

     (1)  Clarifying the graduated penalty structure for repeat violations;

 

     (2)  Inserting a savings clause; and

 

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     Your Committee respectfully requests that, if the measure is considered in conference, the Committee on Conference insert an effective date of January 1, 2027.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2667, S.D. 1, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 2667, S.D. 1, H.D. 2.
