Sir:

 

     Your Committee on Judiciary, to which was referred S.B. No. 2436, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO CHARITABLE SOLICITATION,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to require professional solicitors operating public collection receptacles to solicit donations of non-perishable tangible property who later re-sell the items to deposit funds with charitable organizations within a specified timeframe, provide certain information in financial reports, and prominently disclose certain information on collection receptacles.

 

     Your Committee received testimony in support of this measure from the Goodwill Hawaii and Hawaiʻi Alliance of Nonprofit Organizations.

 

     Your Committee received comments on this measure from the Department of the Attorney General.

 

     Your Committee finds that the State is seeing a rise in donation collection sites that collect donated goods, resell the goods for profit, and provide only a small fraction of the proceeds to the charity advertised to donors on the bin.  Without action to clarify the guidelines for professional solicitors operating public collection receptacles, nonprofit organizations across the State will continue to see donations diverted to for‑profit actions.  This measure will safeguard donation integrity and strengthen trust in the State's nonprofit sector.

 

     Your Committee has amended this measure by making technical, nonsubstantive amendments for the purposes of clarity and consistency.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2436, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 2436, S.D. 2.
