Madame:

 

     Your Committee on Economic Development & Technology, to which was referred S.B. No. 2377, S.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO PROPERTY DAMAGE OF CRITICAL INFRASTRUCTURE FACILITIES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to:

 

     (1)  Establish the class C felony offense of criminal property damage to critical infrastructure facilities; and

 

     (2)  Expand the term "critical infrastructure" to include broadband and cable television networks.

 

     Your Committee received testimony in support of this measure from the Department of Accounting and General Services; Department of the Prosecuting Attorney of the County of Maui; Kauaʻi Police Department; Department of Information Technology of the City and County of Honolulu; Honolulu Police Department; Department of the Prosecuting Attorney of the City and County of Honolulu; Charter Communications; CTIA; and Hawaiian Telcom.

 

     Your Committee finds that there has been an increase in the number of attacks and intentional damage to critical infrastructure, including 9-1-1 systems, hospitals, airports, and law enforcement communications.  Your Committee further finds that damage to broadband and telecommunications infrastructure can disrupt emergency response efforts, commerce, healthcare services, and educational access.  Your Committee recognizes the need to deter these acts and believes this measure will help address this need by establishing a criminal offense for property damage to critical infrastructure facilities, including broadband, wireless, and cable networks.

 

     Your Committee has amended this measure by:

 

     (1)  Including wireless networks within the definition of "critical infrastructure"; and

 

     (2)  Changing the effective date to July 1, 3000, to encourage further discussion.

 

     As affirmed by the record of votes of the members of your Committee on Economic Development & Technology that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2377, S.D. 2, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 2377, S.D. 2, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
