Sir:
Your Committee on Health and Human Services, to which was referred S.B. No. 2106 entitled:
"A BILL FOR AN ACT RELATING TO HEALTH,"
begs leave to report as follows:
The purpose and intent of this measure is to:
(1) Prohibit
the sale of nonprescription diet pills and dietary supplements for weight loss
or muscle building to any person under eighteen years of age; and
(2) Require
retail establishments and delivery sellers to follow certain protocols
regarding certain products to prevent access by minors to the restricted
products.
Your Committee received testimony in support of this measure from four individuals.
Your Committee received testimony in opposition to this measure from the Consumer Healthcare Products Association, Council for Responsible Nutrition, American Herbal Products Association, and Natural Products Association.
Your Committee received comments on this measure from the Department of Health and Hawaii Food Industry Association.
Your Committee finds that certain dietary supplements claiming to enhance weight loss or muscle building capabilities are often poorly regulated, marketed with misleading claims, and may contain ingredients that can cause serious health effects, especially for susceptible youth. Your Committee further finds that placing reasonable restrictions on the commercial sale of certain diet supplements to minors can protect the State's youth from products that can potentially cause lasting harm. This measure establishes safety measures to limit the physiological harm to the State's youth that may arise from nonprescription dietary supplements for weight loss or muscle building.
Your Committee has amended this measure by:
(1) Deleting language relating to marketing or other representation of dietary supplement for weight loss or muscle building and nonprescription diet pills to clarify the intent of the measure;
(2) Inserting an effective date of January 30,
2050, to encourage further
discussion; and
(3) Making
a technical, nonsubstantive amendment for the purposes of clarity and consistency.
As affirmed by the record of votes of the members of your Committee on Health and Human Services that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2106, as amended herein, and recommends that it pass Second Reading in the form attached hereto as S.B. No. 2106, S.D. 1, and be referred to your Committee on Commerce and Consumer Protection.
