Sir:

 

     Your Committees on Commerce and Consumer Protection and Ways and Means, to which was referred S.B. No. 2100, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO PESTICIDES,"

 

beg leave to report as follows:

 

     The purpose and intent of this measure is to:

 

     (1)  Require quarterly rather than annual reporting of certain uses of restricted use pesticides;

 

     (2)  Amend the contents of reports to include specific geospatial data and information and increased detail on the amount of restricted use pesticides used;

 

     (3)  Exempt wood preservative pesticides from reporting requirements; and

 

     (4)  Require the Department of Agriculture and Biosecurity to develop an online reporting tool for restricted use pesticides.

 

     Your Committees received testimony in support of this measure from one member of the Kauaʻi County Council, Green Party of Hawaiʻi, Earthjustice, Hawaiʻi Public Health Institute, Kauai Climate Action Coalition, Hawaii Chapter of the American Academy of Pediatrics, Hawaiʻi Alliance for Progressive Action, Hawaiʻi Farmers Union United, and twenty-eight individuals.

 

     Your Committees received testimony in opposition to this measure from the Hawaii Crop Improvement Association; Hawaiʻi Farm Bureau; Sugarland Farms, Inc.; and CropLife America.

 

     Your Committees received comments on this measure from the Department of Agriculture and Biosecurity, Department of Land and Natural Resources, and American Chemistry Council.

 

     Your Committees find that under existing law, annual reporting on restricted use pesticides does not require detailed information relating to the exact quantities, active ingredients, and application locations of pesticides used.  This measure would require more frequent and specific reporting on pesticide use in the State, which will provide the data required to inform public health studies and scientific analysis, mitigate exposure, and improve public safety and health equity.

 

     Your Committees have amended this measure by:

 

     (1)  Inserting a blank appropriation to establish positions within the Department of Agriculture and Biosecurity to help carry out the purposes of this measure; and

 

     (2)  Making technical, nonsubstantive amendments for the purposes of clarity and consistency.

 

     As affirmed by the records of votes of the members of your Committees on Commerce and Consumer Protection and Ways and Means that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 2100, S.D. 1, as amended herein, and recommend that it pass Third Reading in the form attached hereto as S.B. No. 2100, S.D. 2.
