Madame:

 

     Your Committees on Agriculture & Food Systems and Energy & Environmental Protection, to which was referred S.B. No. 2100, S.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO PESTICIDES,"

 

beg leave to report as follows:

 

     The purpose of this measure is to:

 

     (1)  Require quarterly, rather than annual, reports of certain uses of restricted use pesticides, with certain exceptions;

 

     (2)  Amend the contents of reports to include specific geospatial data and information and increased detail on the amount of restricted use pesticides used; and

 

     (3)  Require the Department of Agriculture and Biosecurity to develop an online reporting tool for restricted use pesticides.

 

     Your Committees received testimony in support of this measure from the Office of Hawaiian Affairs; one member of the Kauaʻi County Council; Hawaiʻi Public Health Institute; League of Women Voters of Hawaii; Earthjustice; Hawaiʻi Alliance for Progressive Action; Hawaiʻi Chapter of the American Academy of Pediatrics; Hawaiʻi Farmers Union United; and numerous individuals.  Your Committees received testimony in opposition to this measure from Sugarland Farms, Inc.; Hawaii Crop Improvement Association; Hawaiʻi Farm Bureau; and Maui Chamber of Commerce.  Your Committees received comments on this measure from the Department of Agriculture and Biosecurity.

 

     Your Committees find that the responsible use of pesticides is essential to protecting the State's agricultural viability, environmental resources, and public health.  Your Committees further find that improved reporting of restricted use pesticide applications through an online reporting tool will assist policymakers and public health experts in better understanding restricted use pesticide application patterns and impacts and making informed decisions that will protect the health of Hawaii's environment and people.

 

     Your Committees have amended this measure by:

 

     (1)  Deleting language that would have:

 

          (A)  Required quarterly, rather than annual, reports of certain uses of restricted use pesticides;

 

          (B)  Amended the contents of reports to include specific geospatial data and information and increased detail on the amount of restricted use pesticides used; and

 

          (C)  Appropriated funds to establish positions;

 

     (2)  Inserting language that appropriates an unspecified amount of funds for the Department of Agriculture and Biosecurity to develop an online reporting tool for restricted use pesticide;

 

     (3)  Changing the effective date to July 1, 3000, to encourage further discussion; and

 

     (4)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the records of votes of the members of your Committees on Agriculture & Food Systems and Energy & Environmental Protection that are attached to this report, your Committees are in accord with the intent and purpose of S.B. No. 2100, S.D. 2, as amended herein, and recommend that it pass Second Reading in the form attached hereto as S.B. No. 2100, S.D. 2, H.D. 1, and be referred to your Committee on Finance.
