Sir and Madam:
Your Committee on Conference on the disagreeing vote of the Senate to the amendments proposed by the House of Representatives in S.B. No. 2031, S.D. 2, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO CONSUMER PROTECTION,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to:
(1) Make it an unfair or deceptive act or practice for businesses to:
(A) Advertise, display, or offer the price of live-ticket events or short-term lodging without clearly and conspicuously disclosing the total price; and
(B) Misrepresent any fees or charges in any offer, display, or advertisement for the sale of live‑event tickets or short-term lodging; and
(2) Specify that any advertisement, display, or offer of short-term lodging or live-event tickets in compliance with the federal Rule on Unfair or Deceptive Fees are in compliance with this measure.
Your Committee on Conference finds that bait-and-switch pricing and misleading fees cause substantial consumer harm in the live-event ticketing and short-term lodging industries, which comprise a significant portion of the State's economy. Recognizing the economic inefficiencies caused by drip pricing practices, the Federal Trade Commission issued a final trade regulation rule in 2025 combatting hidden fees and price misrepresentations. This measure aligns the State with national efforts to end unfair and deceptive pricing practices, thereby increasing transparency and consumer protections.
Your Committee on Conference has amended this measure by making it effective upon its approval.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of S.B. No. 2031, S.D. 2, H.D. 1, as amended herein, and recommends that it pass Final Reading in the form attached hereto as S.B. No. 2031, S.D. 2, H.D. 1, C.D. 1.
