Madame:

Your Committee on Finance, to which was referred S.B. No. 2001, S.D. 1, H.D. 1, entitled:

"A BILL FOR AN ACT RELATING TO THE BANYAN DRIVE COMMUNITY DEVELOPMENT DISTRICT,"

begs leave to report as follows:

The purpose of this measure is to:

(1) Establish the Waiakea Community Development District and Waiakea Community Development District Special Fund;

(2) Amend the membership of the Hawaii Community Development Authority to include representation for, and specify the Authority's powers and duties relating to, the Waiakea Community Development District; and

(3) Appropriate funds for the Authority to implement this measure and to establish a position within the Authority.

Your Committee received testimony in support of this measure from the Department of Land and Natural Resources; Hawaiʻi Community Development Authority; Mayor of the County of Hawaiʻi; Hawaiʻi Island Chamber of Commerce; Hawaiʻi Lodging & Tourism Association; and eight individuals. Your Committee received testimony in opposition to this measure from one individual. Your Committee received comments on this measure from the Office of Hawaiian Affairs.

Your Committee finds that H.B. No. 2616, H.D. 2 (Regular Session of 2026), a substantially similar measure, was previously passed by the House.

Your Committee has amended this measure by:

(1) Deleting its contents and inserting the contents of H.B. No. 2616, H.D. 2, a measure that:

(A) Establishes the Banyan Drive-Makaokū Community Development District and Banyan Drive-Makaokū Redevelopment Agency within the Hawaii Community Development Authority;

(B) Establishes the Banyan Drive-Makaokū Community Development District Special Fund;

(C) Specifies the powers and duties of the Authority as it relates to the new development district and amends the composition of the Authority to include representatives of the new development district; and

(D) Appropriates funds to the Hawaii Community Development Authority and into and out of the Banyan Drive-Makaokū Community Development District Special Fund; and

(2) Clarifying that the lineal descendant member shall be appointed from a list of at least three nominees submitted to the Governor by the Office of Hawaiian Affairs.

As affirmed by the record of votes of the members of your Committee on Finance that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 2001, S.D. 1, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 2001, S.D. 1, H.D. 2.
