Madame:

 

     Your Committee on Economic Development & Technology, to which was referred H.B. No. 2502 entitled:

 

"A BILL FOR AN ACT RELATING TO ARTIFICIAL INTELLIGENCE,"

 

begs leave to report as follows:

 

     The purpose of this measure is to:

 

     (1)  Require operators of conversational artificial intelligence services in the State to issue certain disclosures to account holders and users;

 

     (2)  Require operators to develop protocols to respond to prompts or content associated with suicidal ideation or self-harm in account holders and users;

 

     (3)  Establish protections for minor account holders of conversational artificial intelligence services;

 

     (4)  Require operators to submit annual reports to the Department of Commerce and Consumer Affairs; and

 

     (5)  Authorize the Attorney General to bring civil actions and seek recovery for violations.

 

     Your Committee received testimony in support of this measure from the Department of Education; Google; and Hawaii Teamsters Local 996.  Your Committee received testimony in opposition to this measure from the Chamber of Progress.  Your Committee received comments on this measure from the Department of the Attorney General.

 

     Your Committee finds that the rapid expansion of publicly accessible conversational artificial intelligence services has created new risks related to user safety, informed consent, and the protection of minors.  Your Committee further finds that establishing clear disclosure standards and crisis‑response protocols will help ensure responsible use of these technologies and reduce the likelihood of harmful or misleading interactions.  This measure provides necessary safeguards and accountability mechanisms to protect consumers while supporting the safe integration of artificial intelligence tools into daily life.

 

     Your Committee has amended this measure by:

 

     (1)  Changing the effective date to July 1, 3000, to encourage further discussion; and

 

     (2)  Making a technical, nonsubstantive amendment for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Economic Development & Technology that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2502, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2502, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
