Madame:

 

     Your Committee on Transportation, to which was referred H.B. No. 2442 entitled:

 

"A BILL FOR AN ACT RELATING TO PARKING FOR DISABLED PERSONS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to, beginning July 1, 2027, increase the number of required accessible and van accessible parking spaces in parking lots with more than twenty-five parking spaces that are covered by Title II or III of the Americans with Disabilities Act.

 

     Your Committee received testimony in support of this measure from the Disability and Communication Access Board; Hawaiʻi State Council on Developmental Disabilities; Hawaii Disability Rights Center; and two individuals.  Your Committee received comments on this measure from the University of Hawaiʻi System.

 

     Your Committee finds that individuals with mobility disabilities and many kupuna face significant challenges in accessing businesses and public facilities due to limited availability of accessible parking spaces.  When disabled persons and kupuna are unable to secure parking close to their destination, their ability to participate fully in community life is diminished and their risk of injury, including falling, may increase.  By increasing the minimum number of required accessible and van-accessible parking spaces in larger parking lots covered by the Americans with Disabilities Act, this measure promotes accessibility, safety, and greater inclusion for persons with disabilities and kupuna across the State.

 

     Your Committee has amended this measure by changing the effective date to July 1, 3000, to encourage further discussion.

 

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2442, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2442, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
