     Your Committee on Transportation, to which was referred H.B. No. 2417, H.D. 2, entitled:

 

"A BILL FOR AN ACT RELATING TO ADMINISTRATIVE LICENSE REVOCATION,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to clarify administrative driver's license revocation procedures by specifying the effect of the notice of administrative revocation and conforming related administrative review and hearing provisions.

 

     Your Committee received testimony in support of this measure from the Department of Transportation, Department of the Prosecuting Attorney of the City and County of Honolulu, Department of the Prosecuting Attorney of the County of Maui, and Office of the Prosecuting Attorney of the County of Hawaii.

 

     Your Committee finds that ambiguity in the existing administrative revocation procedures undermines enforcement and accountability as defendants are able to plead ignorance to the suspension of their driver's license.  Essentially, individuals arrested for driving under the influence regularly claim that they did not understand when the suspension of their license commenced.  This measure will clarify the administrative revocation process to close this loophole and improve public safety.

 

     Your Committee has amended this measure by making technical, nonsubstantive amendments for the purposes of clarity and consistency.

 

     As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2417, H.D. 2, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2417, H.D. 2, S.D. 1, and be referred to your Committees on Judiciary and Ways and Means.
