Madame:

 

     Your Committee on Education, to which was referred H.B. No. 2381 entitled:

 

"A BILL FOR AN ACT RELATING TO PUBLIC CHARTER SCHOOLS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to require incentives paid to public charter school teachers under the Teacher National Board Certification Incentive Program and other teacher differentials be paid from funds appropriated to the State Public Charter School Commission, instead of the per-pupil allocation.

 

     Your Committee received testimony in support of this measure from the Office of Hawaiian Affairs; State Public Charter School Commission; and five individuals.  Your Committee received testimony in support of the intent of this measure from the Hawaii Public Charter Schools Network.  Your Committee received comments on this measure from the Department of the Attorney General.

 

     Your Committee finds that currently, incentives paid to public charter school teachers are taken from schools' per-pupil allocation.  This measure will provide that such incentives be appropriated to the State Public Charter School Commission to ensure that the per-pupil allocation is used for its intended purpose of ensuring equitable, needs-based funding for each student.

 

     Your Committee has amended this measure by:

 

     (1)  Establishing a Teacher National Board Certification Incentive Program specifically for public charter school teachers;

 

     (2)  Clarifying that the incentives paid to public charter school teachers under the Teacher National Board Certification Incentive Program established for public charter school teachers and other teacher differentials approved by the Department of Education and implemented by public charter schools be paid from funds appropriated to the State Public Charter School Commission;

 

     (3)  Changing the effective date to July 1, 3000; and

 

     (4)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Education that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2381, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2381, H.D. 1, and be referred to your Committee on Finance.
