Madame:

 

     Your Committee on Water & Land, to which was referred H.B. No. 2375, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO TOWING PRACTICES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to establish a Uniform Towing Practices for Public Parking Facilities Working Group within the Department of Transportation to examine existing state and county laws, ordinances, rules, and administrative practices relating to towing from public parking facilities and develop recommendations for uniform standards applicable to towing from state and county parking facilities.

 

Your Committee received testimony in support of this measure from numerous individuals.  Your Committee received testimony in opposition to this measure from the Department of Commerce and Consumer Affairs.  Your Committee received comments on this measure from the Department of Land and Natural Resources and Save Surf Parking Coalition.

 

     Your Committee finds that the existing patchwork system of different parking concessionaires that manage contracts across Hawaii creates confusion and unpredictability for residents and visitors.  Your Committee further finds that by establishing a Uniform Towing Practices for Public Parking Facilities Working Group, this measure promotes consistent, predictable, and proportional parking penalties statewide.

 

     Your Committee has amended this measure by:

 

     (1)  Adding the Chairperson of the Board of Land and Natural Resources, or the Chairperson's designee, to the working group;

 

     (2)  Changing the appointing authority for the working group representative of a county police department from a neighbor island from the Governor to the applicable mayor, or the mayor's designee;

 

     (3)  Changing its effective date to July 1, 3000, to encourage further discussion; and

 

     (4)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Water & Land that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2375, H.D. 1, as amended herein, and recommends that it be referred to your Committee on Judiciary & Hawaiian Affairs in the form attached hereto as H.B. No. 2375, H.D. 2.
