     Your Committee on Judiciary & Hawaiian Affairs, to which was referred H.B. No. 2321 entitled:

 

"A BILL FOR AN ACT RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT,"

 

begs leave to report as follows:

 

     The purpose of this measure is to update the State's Uniform Controlled Substance Act to make it consistent with amendments to the federal Controlled Substances Act.

 

     Your Committee received testimony in support of this measure from the Department of Law Enforcement.

 

     Your Committee finds that Hawaii's controlled substances regulatory framework is out of alignment with federal law, creating gaps that may be exploited by individuals seeking to manufacture, distribute, or possess substances that are controlled at the federal level but not by the State.  This measure ensures that Hawaii's Uniform Controlled Substances Act is in alignment with the federal Controlled Substances Act.

 

     Your Committee has amended this measure by making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2321, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2321, H.D. 1, and be placed on the calendar for Third Reading.
