Madame:

 

     Your Committee on Public Safety, to which was referred H.B. No. 2264 entitled:

 

"A BILL FOR AN ACT RELATING TO PROTECTIVE ORDERS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to require notification to the security forces of each branch of the United States military when a protective order is issued in a case involving a military-affiliated individual.

 

     Your Committee received testimony in support of this measure from the United States Department of Defense; Department of Business, Economic Development, and Tourism; Hawaiʻi National Guard; Military and Community Relations Office; Hawaiʻi State Coalition Against Domestic Violence; and one individual.  Your Committee received comments on this measure from the Judiciary.

 

     Your Committee finds that nearly 58,000 active-duty, National Guard, and reserve military members and over 21,000 spouses of military members are stationed and living in the State.  Your Committee further finds that when domestic violence occurs within these households, victims often navigate both civilian and military legal systems that have not had an established arrangement for communicating with one another.  This information gap places victims at increased risk and can delay critical intervention.  Your Committee also finds that this measure addresses that gap in a balanced and practical manner by requiring timely information-sharing between the Judiciary, county police departments, the Department of Law Enforcement, and military security forces when a protective order is issued.

 

     Your Committee has amended this measure by:

 

     (1)  Clarifying the parties to the notification process;

 

     (2)  Changing its effective date to July 1, 3000, to encourage further discussion; and

 

     (3)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Public Safety that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2264, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2264, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
