Sir:

Your Committee on Ways and Means, to which was referred H.B. No. 2250, H.D. 2, S.D. 1, entitled:

"A BILL FOR AN ACT MAKING APPROPRIATIONS FOR CLAIMS AGAINST THE STATE, ITS OFFICERS, OR ITS EMPLOYEES,"

begs leave to report as follows:

The purpose and intent of this measure is to appropriate moneys to satisfy claims against the State for judgments, settlements, and other miscellaneous payments.

Your Committee received written comments in support of this measure from the Department of Land and Natural Resources, Department of Transportation, Department of Education, Department of the Attorney General, and Department of Corrections and Rehabilitation.

Your Committee finds that this measure requests a total of $17,144,004.25 in appropriations from the general fund and a total of $2,068,186.76 in appropriations from the state highway fund to satisfy claims against the State. Timely passage of this measure will minimize interest on those amounts. However, your Committee recognizes that part III of the measure does not make an appropriation for a claim against the State and therefore potentially violates the single-subject requirement for bills under Article III, section 14, of the Hawaii State Constitution.

Your Committee also recognizes that, since this measure was last amended, additional claims have been resolved for a total amount of $1,108,588.01.

Your Committee has amended this measure to adopt recommendations made in written comments from the Office of the Attorney General, that specifically:

(1) Add seven miscellaneous claims totaling $633,588.01;

(2) Restore language for a claim against the Department of Agriculture and Biosecurity in the amount of $151,132.00;

(3) Add a claim against the Department of Human Services in the amount of $475,000.00;

(4) Delete three claims of unspecified amounts; and

(5) Delete part III of the measure.

Your Committee has also amended this measure to change the effective date of the measure to effective upon its approval.

As affirmed by the record of votes of the members of your Committee on Ways and Means that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2250, H.D. 2, S.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 2250, H.D. 2, S.D. 2.
