Your Committee on Consumer Protection & Commerce, to which was referred H.B. No. 2164, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO WORKERS' COMPENSATION,"
begs leave to report as follows:
The
purpose of this measure is to
define "compounded prescription drug" for purposes of the Workers'
Compensation Law.
Your Committee received testimony in support of this measure
from the Department of Labor and Industrial Relations; Hawaii RePack; Work
Injury Medical Association of Hawaiʻi; Solera Integrated Medical Solutions; and
Hawaii Insurers Council. Your Committee
received testimony in opposition to this measure from the Department of Human
Resources Development.
Your Committee finds
that compounded prescription drugs may be medically necessary for injured
workers when FDA-approved medications are not appropriate due to individual
clinical needs, such as allergies, dosage requirements, or other clinical
considerations. Your Committee further
finds that inconsistent definitions under existing law have created confusion
regarding the appropriate use, safety standards, and reimbursement of
compounded prescription drugs within the workers' compensation system. Aligning state law with established federal
compounding standards will promote patient safety, improve regulatory
consistency, and provide clearer guidance regarding when compounded
prescription drugs are appropriate, while preserving access to individualized medications
when medically necessary.
As affirmed by the record of votes of the members of your Committee on Consumer Protection & Commerce that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2164, H.D. 1, and recommends that it pass Third Reading.
