Madame:

 

     Your Committee on Judiciary & Hawaiian Affairs, to which was referred H.B. No. 2097 entitled:

 

"A BILL FOR AN ACT RELATING TO ADMINISTRATIVE DRIVERS LICENSE REVOCATION,"

 

begs leave to report as follows:

 

     The purpose of this measure is to:

 

     (1)  Authorize administrative drivers license revocation hearings to be conducted using interactive conference technology, including teleconference, videoconference, and voice over internet protocol (VoIP) systems; and

 

     (2)  Clarify that evidence in hearings conducted via interactive conference technology may be submitted and exchanged electronically.

 

     Your Committee received testimony in support of this measure from the Judiciary.

 

     Your Committee finds that administrative driver's license revocation hearings are time-sensitive proceedings that must be conducted efficiently while preserving due process for respondents.  Your Committee further finds that authorizing the use of interactive conference technology for these hearings can improve access to justice, reduce delays, and promote the timely resolution of cases, particularly when in-person appearances are impractical.  Allowing electronic submission and exchange of evidence in hearings conducted by interactive conference technology modernizes the administrative hearing process while maintaining fairness, reliability, and procedural integrity.

 

     Your Committee has amended this measure by making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2097, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2097, H.D. 1, and be placed on the calendar for Third Reading.
