Your Committee on Public Safety and Military Affairs, to which was referred H.B. No. 2062, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO GUN VIOLENCE PREVENTION,"
begs leave to report as follows:
The purpose and intent of this measure is to:
(1) Appropriate funds to the Judiciary for the efficient processing of temporary restraining orders and gun violence protective orders; and
(2) Appropriate funds to the Department of Law Enforcement to conduct public awareness campaigns on gun violence protective orders.
Your Committee received testimony in support of this measure from the Department of Law Enforcement, two members of the Hawaii County Council, Gifford's Gun Owners for Safety, Brady Hawaii, Hawaiʻi State Association of Counties, Moms Demand Action for Gun Sense in America Hawaii Chapter, and fifty-three individuals.
Your Committee received testimony in opposition to this measure from the Mid Pacific Pistol League, SDM Training Group, Bows N Bullets, Hawaii Firearms Coalition, National Rifle Association Institute for Legislative Action, and forty-three individuals.
Your Committee received comments on this measure from the Judiciary.
Your Committee finds that Act 150, Session Laws of Hawaii 2019 (Act 150), established a framework for gun violence protective orders. These orders are a critical tool in preventing gun violence by allowing law enforcement and family members to petition the court to temporarily remove firearms from individuals who pose a significant danger to themselves or others. However, the effectiveness of gun violence protective orders depends on public awareness and efficient processing of orders. Despite Act 150, many potential petitioners, including family members and law enforcement officers, remain unaware of gun violence protective orders. This measure appropriates funds for public outreach efforts and efficient processing of protective orders, which will support public safety in the State.
Your Committee has amended this measure by inserting an effective date of July 1, 2055, to encourage further discussion.
As affirmed by the record of votes of the members of your Committee on Public Safety and Military Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2062, H.D. 1, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2062, H.D. 1, S.D. 1, and be referred to your Committees on Ways and Means and Judiciary.
