Your Committee on Judiciary & Hawaiian Affairs, to which was referred H.B. No. 2062 entitled:
"A BILL FOR AN ACT RELATING TO GUN VIOLENCE PREVENTION,"
begs leave to report as follows:
The purpose of this measure is to appropriate funds to:
(1) The Judiciary to enforce gun violence protective orders; and
(2) The Department of Law Enforcement to conduct public awareness campaigns on gun violence protective orders.
Your Committee received testimony in support of this measure from the Department of Law Enforcement; one member of the Hawaiʻi County Council; Moms Demand Action; Hawaiʻi Chapter Moms Demand Action for Gun Sense in America; Students Demand Action; and numerous individuals. Your Committee received testimony in opposition to this measure from Mid Pacific Pistol League; Gifford's Gun Owners for Safety; SDM Training Group/Bows N Bullets; Puʻuloa Rifle and Pistol Club; For Liberty and Justice Hawaii; Hawaii Firearms Coalition; and numerous individuals. Your Committee received comments on this measure from the Judiciary; Hawaiʻi Government Employees Association, AFSCME Local 152, AFL-CIO; and one individual.
Your Committee finds that gun violence is rising in the United States. While Hawaii has strong gun safety laws and low gun death rates, the State still faces increasing incidents of gun violence. Your Committee notes that Act 150, Session Laws of Hawaii 2019, established a preventative gun violence protective order law that allows certain individuals to petition a court to temporarily prevent or remove an individual's access to firearms if the individual poses a danger to themselves or others. Your Committee believes that there is a need for increased funding for community intervention, public awareness, and improved access to information about preventative gun violence protective orders.
Your Committee notes that the Judiciary's role is to interpret laws and the Judiciary does not have the authority to enforce laws. Your Committee recognizes that it would be more prudent to provide funding to the Judiciary to ensure that gun violence protective orders and temporary restraining orders are processed efficiently.
Your Committee has amended this measure by:
(1) Clarifying that the appropriation to the Judiciary is to effectuate the efficient processing of temporary restraining orders and gun violence protective orders, rather than to enforce gun violence protective orders;
(2) Changing the effective date to July 1, 3000, to encourage further discussion; and
(3) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2062, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2062, H.D. 1, and be referred to your Committee on Finance.
