Madam and Sir:

 

     Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 2023, H.D. 2, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO TRANSPORTATION,"

 

having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.

 

     The purpose of this measure is to:

 

     (1)  Require the Director of Transportation to administer a statewide program (Program) for certification of active intelligent speed assistance systems and select a vendor for the installation and maintenance of systems;

 

     (2)  Limit the civil liability of motor vehicle manufacturers, distributors, and retailers for active intelligent speed assistance systems;

 

     (3)  Make circumvention of or tampering with an active intelligent speed assistance system a misdemeanor; and

 

     (4)  Allow the Judiciary to impose the installation of active intelligent speed assistance systems as an additional penalty and as part of a license suspension or revocation for repeat offenders of certain traffic violations.

 

     Your Committee on Conference has amended this measure by:

 

     (1)  Clarifying provisions relating to circumventing of or tampering with an active intelligent speed assistance system;

 

     (2)  Clarifying provisions relating to violations of operating a motor vehicle in violation of a court-ordered active intelligent speed assistance system requirement;

 

     (3)  Amending the definition of "active intelligent speed assistance system";

 

     (4)  Deleting provisions related to noncompliance with speed limit;

 

     (5)  Clarifying provisions relating to the Judiciary's authority to impose the installation of active intelligent speed assistance systems as an additional penalty and as part of a license suspension or revocation for repeat offenders of certain traffic violations;

 

     (6)  Changing the effective date to January 1, 2028, with the provisions related to the establishment of the Program and automobile manufacturer, distributor, and retailer responsibility and liability taking effect upon approval; and

 

     (7)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 2023, H.D. 2, S.D. 1, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 2023, H.D. 2, S.D. 1, C.D. 1.
