Madame:
Your Committee on Tourism, to which was referred H.B. No. 1946 entitled:
"A BILL FOR AN ACT RELATING TO REGISTRATION OF TIME SHARES,"
begs leave to report as follows:
The
purpose of this measure is to
provide that:
(1) Applications for registration renewal required under section 514E-10, Hawaii Revised Statutes, shall be deemed approved upon delivery; and
(2) Any amendment to a required time share plan registration shall be deemed approved by operation of law on the forty-fifth day after the amendment is submitted to the Director of Commerce and Consumer Affairs, unless the Director issues a deficiency letter within that period.
Your Committee finds
that time share accommodations are an important part of the State's visitor
industry and provide a consistent and steady stream of visitors and
revenue. Your Committee further finds
that the State's time share registration requirements require developers to
file an application with the Department of Commerce and Consumer Affairs for
registration renewals or when there is an amendment to the plan. However, review and approval of these filings
are often delayed, which impairs the time share industry's ability to maintain
and attract time share owners and consumers and prevents consumers from
receiving the most current information about purchases of time shares. This measure is intended to streamline the
time share registration renewal and amendment filing process by establishing a
framework for the automatic approval of certain statutorily required filings.
Your
Committee has amended this measure by:
(1) Changing the effective date to July 1, 3000,
to encourage further discussion; and
(2) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Tourism that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1946, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1946, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
