Your Committee on Judiciary & Hawaiian Affairs, to which was referred H.B. No. 1880, H.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO PESTICIDES,"
begs leave to report as follows:
Your Committee received testimony in support of this measure from one member of the Kauaʻi County Council; Hawaii Public Health Institute; Hawaiʻi Reef & Ocean Coalition; Kanalani Ohana Farm; Hawaiʻi Food+ Policy; Kauai Climate Action Coalition; League of Women Voters of Hawaii; Hawaiʻi Alliance for Progressive Action; and numerous individuals. Your Committee received testimony in opposition to this measure from the Chamber of Commerce Hawaii; Hawaiʻi Farm Bureau; Land Use Research Foundation of Hawaii; Dole Food Company; and one individual. Your Committee received comments on this measure from the Department of Agriculture and Biosecurity and Hawaii Crop Improvement Association.
Your Committee finds that 1,3-dichloropropene, commonly known as Telone, is a restricted-use pesticide associated with significant public health and environmental concerns, including risks from pesticide drift that are difficult to fully mitigate under existing law. Your Committee further finds that prohibiting the use or application of pesticides containing 1,3-dichloropropene, with a delayed effective date, is consistent with prior legislative action to restrict hazardous pesticides and appropriately balances public health protection with regulatory certainty.
Your Committee has amended this measure by:
(1) Changing the starting date on the prohibition on the use or application of a pesticide containing 1,3-dichloropropene as an active ingredient to January 1, 2030;
(2) Inserting a savings clause; and
(3) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1880, H.D. 2, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 1880, H.D. 3.
