Your Committee on Consumer Protection & Commerce, to which was referred H.B. No. 1880, H.D. 1, entitled:
"A BILL FOR AN ACT RELATING TO PESTICIDES,"
begs leave to report as follows:
Your Committee received testimony in support of this measure from the Green Party of Hawaiʻi; Hawaiʻi Alliance for Progressive Action; Hawaiʻi Public Health Institute; Hawaiʻi Farmers Union United; Hawaiʻi Food+ Policy; Kauai Climate Action Coalition; Kanalani Ohana Farm; and numerous individuals. Your Committee received testimony in opposition to this measure from the Hawaiʻi Farm Bureau and Dole Food Company Hawaii. Your Committee received comments on this measure from the Department of Agriculture and Biosecurity and Hawaii Crop Improvement Association.
Your Committee finds that 1,3-dichloropropene is a soil fumigant used to control nematodes, fungal diseases, insects, and other soil-dwelling pests on crops, such as sweet potatoes, pineapples, and onions. There are no residential uses for 1,3-dichloropropene.
Your Committee further finds that all products with 1,3-dichloropropene are restricted use pesticides subject to strict sales and use regulations under the supervision of the Department of Agriculture and Biosecurity. Although there are substantial regulations around the sale and use of 1,3-dichloropropene, your Committee additionally finds that 1,3-dichloropropene is classified as a likely carcinogen in the United States and banned in forty countries. This measure protects the health of residents of the State by prohibiting the use or application of 1,3-discloropropene.
Your Committee has amended this measure by changing the effective date to July 1, 3001, to encourage further discussion.
As affirmed by the record of votes of the members of your Committee on Consumer Protection & Commerce that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1880, H.D. 1, as amended herein, and recommends that it be referred to your Committee on Judiciary & Hawaiian Affairs in the form attached hereto as H.B. No. 1880, H.D. 2.
