Madame:

 

     Your Committee on Judiciary & Hawaiian Affairs, to which was referred H.B. No. 1753, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO SOCIAL MEDIA,"

 

begs leave to report as follows:

 

     The purpose of this measure is to require certain social media platforms to:

 

     (1)  Provide an accessible mechanism for users to delete their accounts;

 

     (2)  Permanently delete all personal information and sensitive personal information associated with deleted accounts; and

 

     (3)  Prohibit deceptive practices that obstruct deletion.

 

     Your Committee received testimony in support of this measure from one individual.  Your Committee received comments on this measure from the Department of Commerce and Consumer Affairs.

 

     Your Committee finds that social media platforms collect and retain extensive personal information, often continuing to store data long after users believe it has been deleted.  Your Committee further finds that unclear deletion processes, indefinite retention of sensitive personal information, and interface designs that make account deletion difficult undermine user privacy and control over their digital identities.  Your Committee believes that establishing clear deletion rights and prohibiting deceptive barriers to data removal will give users meaningful control over their personal information and strengthen digital privacy safeguards statewide.

 

     Your Committee has amended this measure by:

 

     (1)  Clarifying the definition of "covered platform" to mean a social media platform that:

 

          (A)  Has one million or more monthly active users nationwide; or

 

          (B)  Generates $25,000,000 or more in annual gross revenues;

 

     (2)  Clarifying that a covered platform shall maintain deletion request records and any related compliance documentation for four years for enforcement and evidentiary purposes;

 

     (3)  Inserting a savings clause; and

 

     (4)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary & Hawaiian Affairs that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1753, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as H.B. No. 1753, H.D. 2.
