Madame:
Your Committee on Consumer Protection & Commerce, to which was referred H.B. No. 1753 entitled:
"A BILL FOR AN ACT RELATING TO SOCIAL MEDIA,"
begs leave to report as follows:
The purpose of this measure is to require certain social media platforms to:
(1) Provide an accessible mechanism for users to delete their accounts;
(2) Permanently erase all personal information associated with deleted accounts; and
(3) Prohibit deceptive practices that obstruct deletion.
Your Committee finds that social media platforms collect vast amounts of data on their users, from browsing habits to personal preferences. This data may be used to not just provide a personalized advertising experience, but also to shape the user's online experience. However, users should have meaningful control over their personal information and data. This measure provides users with control over their data upon their decision to terminate the use of a social media platform by requiring the platform to delete all personal information associated with the user's deleted account.
Your Committee has amended this measure by:
(1) Amending the definition of "delete" or "deletion" to take into consideration whether such deletion is technically feasible;
(2) Amending the definition of "personal information" to identify specific types of information;
(3) Inserting a definition of "sensitive personal information" and broadening this measure to include the deletion of such information;
(4) Inserting a definition of "user";
(5) Requiring a covered platform to:
(A) Archive and not make publicly accessible a user's personal information and sensitive personal information for forty-five days after receiving the confirmed request to delete the account;
(B) Delete the user's personal information and sensitive personal information no later than ninety days after receiving the confirmed request to delete the account; and
(C) Not delete the personal information or sensitive personal information if a law enforcement agency directs the covered platform pursuant to a law enforcement agency-approved criminal investigation with an active case number to not delete the information;
(6) Changing the effective date to July 1, 3000, to encourage further discussion; and
(7) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the members of your Committee on Consumer Protection & Commerce that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1753, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1753, H.D. 1, and be referred to your Committee on Judiciary & Hawaiian Affairs.
