Your Committee on Finance, to which was referred H.B. No. 1749, H.D. 2, entitled:

"A BILL FOR AN ACT RELATING TO CESSPOOLS,"

begs leave to report as follows:

The purpose of this measure is to:

(1) Beginning January 1, 2027, require sellers of residential real property to provide buyers with a cesspool disclosure form before the execution of a real estate purchase contract;

(2) Establish a fine for failure to provide the disclosure form; and

(3) Require the Department of Health and Real Estate Commission to develop a standardized cesspool disclosure form by November 1, 2026.

Your Committee received testimony in support of this measure from the Department of Land and Natural Resources; Department of Health; Office of Planning and Sustainable Development; University of Hawaiʻi Sea Grant College Program; University of Hawaiʻi Water Resources Research Center; Climate Change and Health Working Group; Hawaiʻi Association of REALTORS; WAI: Wastewater Alternatives & Innovations; Hawaiʻi Reef and Ocean Coalition; and three individuals.

As affirmed by the record of votes of the members of your Committee on Finance that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1749, H.D. 2, and recommends that it pass Third Reading.
