Madam and Sir:
Your Committee on Conference on the disagreeing vote of the House of Representatives to the amendments proposed by the Senate in H.B. No. 1692, H.D. 2, S.D. 2, entitled:
"A BILL FOR AN ACT RELATING TO TRAFFIC SAFETY,"
having met, and after full and free discussion, has agreed to recommend and does recommend to the respective Houses the final passage of this bill in an amended form.
The purpose of this measure is to:
(1) Require
drivers approaching stationary vehicles displaying warning signals to slow down
to a reasonable and prudent speed and make a lane change if possible and safe
to do so or come to a complete stop if necessary;
(2) Prohibit
the operation of a pickup truck with a passenger seated in the bed or
load-carrying area on roadways with posted speed limits of forty-six miles per
hour or higher and roadways with three or more lanes traveling in the same
direction;
(3) Provide
certain exemptions from passenger restrictions; and
(4) Increase
the minimum age to ride in the bed or load-carrying area of a pickup truck
while in operation from twelve years of age to eighteen years of age.
Your
Committee on Conference has amended this measure by:
(1) Setting out provisions related to duties of drivers approaching stationary vehicles displaying warning signals as a new section in chapter 291C, Hawaii Revised Statutes;
(2) Deleting language that would have prohibited the operation of a pickup truck with a passenger seated in the bed or load-carrying area on roadways with posted speed limits of forty-six miles per hour or higher and roadways with three or more lanes traveling in the same direction;
(3) Changing the minimum age to ride in the bed or load-carrying area of a pickup truck while in operation to sixteen years of age;
(4) Changing the effective date to upon approval; and
(5) Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.
As affirmed by the record of votes of the managers of your Committee on Conference that is attached to this report, your Committee on Conference is in accord with the intent and purpose of H.B. No. 1692, H.D. 2, S.D. 2, as amended herein, and recommends that it pass Final Reading in the form attached hereto as H.B. No. 1692, H.D. 2, S.D. 2, C.D. 1.
